Access road and pad adequately rocked. Secondary containment located on pad beneath rig. UDI 61 Rig currently drilling 8H. No pits onsite, tanks utilized for drilling operations. Closed loop system being utilized, operator plans to remove all wastes (including cuttings) from site and transport to approved facility. Wood chips are being mixed with cuttings prior to final disposal. No IW or accelerated ES issues noted onsite. Bmp's installed and functioning properly. Operator should continue to monitor and maintain all BMPS until final restoration achieved. Company man informed department that area behind well pad is not related to drilling activities, but rather HCPP.

During inspection well drilled, rig off site. Sign ES plan, Escp-1 and PPC plan onsite.

Three tanks onsite surrounded by temporary containment. Pad lined with temp containment, actively being disposed of. Production equipment actively being installed. The fill slope at the northern end of pad along power plant road appears to be sliding.

At the time of this inspection it does not appear that erosion has occurred outside LOD. Operator has contacted engineer and preliminary plans are to either install rock gabions and/or additional bmp's in order to aid in stabilization of slope. Vegetative matting previously installed also appears to have slid with material along fill slope. Road side ditches and culverts are going to be protected by bmp's in order to prevent a possible pollution event.

2041947 2012-02-02 No Violations Noted Follow up Inspection result of notification from Stephen Smith of XTO ON 1/30/12 (and inspection) of possible ES concerns with slope stability along power plant road. Field meeting conducted to review written response addressing the slope instability with myself, WQS Marc Maestra, Rick Palmer, and XTO reps Stephen Smith, Dan Rice, as well as XTO's engineer During this meeting department noted that slope has moved slightly from 1/30/12 inspection. Although it appears that fill material is sliding down northern slope of pad near power plant RD, there again does not appear to be evidence of accelerated erosion and/or sedimentation issues outside of LOD at this time. Location of hillside failure is located near well heads and there is some distance (exacts not avaliable. ~100ft +) btw production equipment and location. Therefore, at this time XTO nor department feel that production equipment will be impacted by the slide and/or remediation efforts. A minor modification to ESCGP-1 shall be submitted to SWRO XTO agreeded to notifiy us at start of work

During this inspection construction crews actively addressing slope failure. (1) Two sections of large compost sox, culvert pipe and rock outlet (2) Slope was being cut back to reduce grade (3) a rock wall being placed at toe of slope to prevent further slide. Construction crews onsite were planning to have slope regraded by end of today.

Department will follow up early next week to examine completion of restoration/stabilization activities

2045806 2012-02-27 No Violations Noted ollow up Inspection to examine remediation measures ongoing to address pad slope failure at multi well pad. At the time of today’s inspection, it appears operator has completed earth disturbance work related to the remediation of slope failure. The slope appears to have been re-grade and tapered to a 2:1 and 3:1 slope. In addition to a rocked lined ditch, swale, diversion pipe, and compos sox; operator installed erosion control mats over slope. Operator plans to seed/mulch areas this week. According to XTO rep Stephen Smith, the construction sequence outlined on January 30, 2012 was followed, except for the installation of a gabion wall. AT this time the operator feels that a gabion wall is not necessary, but operator will continue to closely monitoring the area and if any additional movement is noted a gabion wall will be installed. During inspection, no accelerated ES issues were noted on pad or access road. Department will conduct a follow up inspection to ensure slope failure has been successfully controlled/corrected.

Based on operator respsone it appears that spill was properly handled accoridng to existing policy. Department reccomends that operator conitnue to closely mointor and maintain all bmp's and containment areas to ensure adequate preventative measures are maintained. A follow up site inspection will be conducted to ensure that distrubed areas are properly restored.

Site has been temporarily stabilized, operator has intention of drilling several more wells on property, to date permits have been obtained for 7H and 9H. Four MEI boxes located onsite, along with two roll off boxes. All appear sound. Four brine tanks and prodcuiton equipment located onsite within lined metal containment. Site has been temporarily stabilized, operator has intention of drilling several more wells on property, to date valid permits exists for 7H and 9H but drilling has not yet commenced; therefore, site has not yet been restored to PCSM plan. Four brine tanks and production equipment located onsite within lined metal containment. No IW leaks or discharges noted.
