| The Department was at the above referenced Marcellus Well site to conduct a pre operation inspection.  A gas well was spudded on site before this inspection.  This is a written warning that inspections must be conducted at all non-conventional well sites before being gas wells are spudded.  The inspection results will be no violations with the pollution prevention noted as compliance assistance.  The site is less than 5 acres and an ESCGP-1 was not obtained.  An E/S plan was developed and the Operator is in the process of getting an ESCGP-1 because the gathering line and the well pad will be over 5 acres combined.  The site is temporarily stabilized but the E/S Controls were removed.  These controls have to be in place in accordance with the E/S Plan.  If the land owner is farming the field, the E/S controls maybe temporarily removed; but will need replaced before the well site is restored.

It was proposed that the removed material would be placed next to the existing stockpile and silt sock be added on the eastern portion for erosion control.
