2294639 Primary Facility 08/06/2014 Administrative/File Review In Compliance with Policy Admin inspt in response to record 2293707 for the reported release of water from annulus of Oriskany well.Dept spoke to Opr rep Erik Greenert via phone.Mr. Greenert stated that while circulating on 7/31, a valve blew fitting out.Opr tried to kill well with mud water.Per Mr. Greenert, the release occurred 8/1 at 1608 and was subsequently reported to the Dept at 1730.Estimated quantity of release is reported to be 21 gallons of "mostly freshwater with a little brine" and is believed to a result of a possible hole in the casing.Conductivity field readings of fluids recorded by Opr is reported to be 800 umHos/cm.Spill remained on-site, localized, no waterways affected.After emergency plugging operations are completed, all visibly impacted materials will immediately be excavated and properly disposed of per current regs.Dept recom'ds Opr collect field readings to ensure all contaminated materials are adequately removed prior to restoration of site.A FUI will be conducted to assess any env'l impacts and/or issue viols as necessary.E-mail requested.

2392338 Primary Facility 07/15/2015 Routine/Complete Inspection Violation(s) Noted At time of inspection, Oriskany well appears plugged with permit number affixed to vent pipe.Located w/in pasture.According to records, drilling occurred 7/22/1987-8/07/1987.Emergency plugging of well completed on 8/15/2014.AR stabilized.At time of inspt, Dept observed agl activities (i.e. animal grazing) taking place on/surrounding well site; as a result, permanent stabilization has been compromised.Dept recommends Opr provide documentation showing that well site has been restored to pre-existing conditions (ag activities), and documentation from landowner stating that AR shall remain, and include who will be the responsible party for maintenance of any PCSM BMPs that may be installed.Well site restoration should be submitted to Dept no later than COB today. Two brine tanks remain on-site.Hence a viol is being issued for Opr's failure to remove all production or storage facilities, supplies, and equipment within 9 months after plugging a well.Add'l viols may be forthcoming upon verification of submittal and/or review of documentation.
2394902 Primary Facility 07/22/2015 Administrative/File Review Outstanding Violations - No Viols Req'd Admin inspt conducted in reference to record 2392338 (enf ID 327722).At 1523, Dept left phone message for XTO rep M.Breitenbach.At 1547, Ms. Breitenbach returned Dept’s phone call.As Dept observed ag activities (i.e. animal grazing) taking place on/surrounding well site and compromising perm stabilization, Dept recommended to Ms. Breitenbach that documentation is provided showing well site has been restored to pre-existing conditions (ag activities), and documentation from landowner is provided stating that AR shall remain, and to include who will be responsible party for maintenance of any PCSM BMPs that may be installed.As discussed w/Ms. Breitenbach, per current regs, Opr shall submit a WSRR to Dept w/in 60 days after restr date.Dept notified Ms. Breitenbach that b/c 2 BTs remain on-site, it is a viol of current regs which provide “Within nine months after plugging a well, the owner or operator shall remove all production or storage facilities, supplies and equipment ...”Viols exist under record 2392338 (enf ID 327722).

Per admin inspt 2397997, Opr is planning to reclaim AR by re-grading/seeding/mulching for final site restoration.Two BTs previously located on-site have been removed.Viols issued for failure to remove prod equipment have been corrected; however, viols for failure to restore well site remain outstanding.Following inspt at 1412, Dept contacted Opr rep Dan Rice via phone to discuss current site conditions (i.e. location of perimeter fence).Mr. Rice stated perimeter fence is in place as a temp measure to minimize potential interference from surrounding ag activities (i.e. animal grazing) while Opr performs necessary reclamation efforts.
