Site ID sign in place. E&S plan in place. Well is not equipped for production (well head only). Drill pit appeared sound and had adequate freeboard. Access road ok. Inspection revealed the following deficiencies:

 1)  Failure to obtain a waiver of distance requirements from a tributary to Little Mahoning Creek (HQ). - Edge of disturbance of the well 
      site was found to be 76 feet from an oxbow in the tributary which had a defined bed and bank, and flowing water present.  Due to the steep slope of the site additional BMP's are needed to avoid any erosion/sedimentation problems.  This concern was addressed on site with operator representative Mike Gatsky.  According to Mr. Gatsky equipment would be brought in to terrace the site and a 12" filter sock would be installed below the filter sock that was already in place.  Please submit an OG-57 after the fact waiver submittal, along with a copy of the revised E&S plan to the address at the top of page 1.

Site ID sign in place. E&S plan in place with revisions. Well was equipped for production. Access road ok. Disturbed areas along access road seeded and mulched. 12" filter sock was installed on the down-slope side of the site for additional protection to the stream. The steep fill slope on the site was being terraced at time of inspection. NOV was issued on 3/8/10 for failure to obtain a waiver of distance requirements from a tributary to Little Mahoning Creek (HQ). The inspection on 3/8/10 was conducted during a period of heavy snow cover, and it appeared that the edge of disturbance of the well site extended further down the bank than it actually did, and that the disturbance was less than 100' from the stream. Following the recent snow melt Mr. Gatsky requested I reevaluate the distance and the waiver requirement. Inspection revealed the edge of disturbance was in fact greater than 100' from the stream and no waiver was required.
