In future E&S plans the operator should clearly outline how drill cuttings were to be disposed of and resolve any possible issues involving the disposal of drill cuttings and the seasonal high groundwater table as outlined in 78.62 and 78.62.

Class H compressor strength at 540 psi (24 hr) and 1379 psi (24 hr) for type I with additives and retention blockers.

Noted soil pile was temporarily seeded to reduce E&S concerns. E&S controls (compost sox¿s, sediment trap and ditches) were installed as noted in E&S plan. No accelerated E&S issues were note in relation to site or access road. Contacted Matt Barch 5/28/10 via telephone to express concerns with freeboard levels on frac pit, and plans for drill cutting disposal, as well as the movement of water through drainage ditches toward sediment traps. Ditches may need additional rip-rap and re-contoured to ensure proper flow in order to prevent build up of water within ditches and pit levels will have to be closely monitored. Matt assured me that someone would be onsite ASAP to address the concerns in order to prevent a possible pollution event that could result in a violation. 1897068 2010-07-01 Outstanding Violations - No Viols Req'd Follow up from 6/10/10 inspection Met on site with Matt Barch, Compliance Specialist of Chief OG, to obtain soil samples from pollution site in question. Two samples were taken from area in question, as well as two background samples and submitted to dept¿s lab.Disturbed soil appeared discolored (darken and oily) and contained a slight odor. According to operator, area had been previously dug up and re-mulched, but it appeared some spill impacted soils were present at this inspection. Upon inspection, Chief expressed plans to re-excavate disturbed area to approximately 12 inches in depth immediately. Chief plans to continue investigation to determine the chain of events that lead to the pollution event, as well as the source. Operator plans to develop a time line of events that document occurrence and remediation process. Pit freeboard had been restored at the time of this inspection AND no new violations were noted. Dept is awaiting sample results and inspection of final remediation measures prior to closing notice of violation.
1899121 2010-07-09 Outstanding Violations - No Viols Req'd This inspection is an investigation of a complaint shared from Air Quailty (increased dust and roadway hazards). Upon inspection, minimal dust was observed at entrance to well site (and impoundment). Sub contractor (Keystone) Rep, Josh was onsite during inspection, and dept recommended that additional rock be added to entrance and/or sweep/remove dirt from edge of access road. At time of inspection, it appeared roadways were clean; dept did not detect mud/ rock on township roadway (Laurel Run Road). Again, dept recommended that operator continue to monitor and maintain access road entrance and or sweep roadway to avoid materials from depositing on township road in question and to minimize dust. At the time of inspection no new violations were noted, while operator and DEP cooperatively and actively investigating and remediating the area where a reported discharge was noted on June 10, 2010 inspection. Site is monitored by 24hr security guard.
1912699 2010-07-22 Outstanding Violations - No Viols Req'd The department is till awaiting final sample results on samples taken on July 1, 2010. Chief O&G Rep Matt Barch was onsite during inspection. Department and Chief cooperatively examined remediation done to disturbed area; area was excavated down approximately 12inches and contaminated soil was removed offsite. Then seed and mulch was placed on area. Growth had not yet been observed. Upon inspection, both observed minor E&S concerns from runoff along remediated area. In order to address the E&S issues the dept and Chief are cooperatively developing/ and will implement a bmp that will reduce/eliminate any runoff that may occur as a result of the remediation. At this violation for discharge on 6/10/10 is outstanding, follow up soil samples will be done (once initial samples results are received from 07.01.10 sampling) to ensure all impacted soils have been removed. At this inspection operator could not identify source of discharge/spill, investigation was ongoing. Pit had been removed at this inspection
1912710 2010-08-31 Outstanding Violations - No Viols Req'd On 08/10/10, dept received notification from Matt Barch via email with pictures that area had been restored. Spoke with Matt Barch on telephone after receiving email, he state that area impacted by unknown discharge had been reclaimed and stabilized. Operator chose to rock previously impacted area in order to resist erosion and permanently restore in a timely fashion, as uniform vegetative cover could be achieved rapidly due to lack rainfall. This was discussed with myself as well as WQS Ed Ritzer. During this inspection, I noted discoloration of the soil from a distance at the toe of the slope that was previously impacted by a discharge. (See pictures) Upon further investigation I noted a ¿black staining on rocks with an oily residue.¿ I immediately called Matt Barch of Chief schedule a site meeting for 9/2/10 to investigate the supposed reclaimed area,discharge was still present and source still unidentifiable by operator. Reccomended construction crew be avaliable for mtg Discharge vio outstanding no new viols ided. Accompanied by Dana Burk WQS
1913079 2010-09-02 Outstanding Violations - No Viols Req'd Matt Barch, Lou Schall and sub contractors along with McCutcheon onsite. Presence of oily residue on rocks/soil operator skimMED rock from top of previously impacted soil. ¿dark, oily liquid appeared to be seeping from the top of the slope, just below pad. Dept took a soil sample and liquid sample. At this point, it appeared seep was coming from directly under pad,operator chose to dig a series of ¿test holes¿ in a line toward well head & observed weather or not the ¿oily substance¿ was encountered. today operator was unable to identify the source of the discharge.Approximately 17 test holes were drilled, and half of these demonstrated the oily substance Chief attempted to delineate an area of impact, Dept recommended that operator contain/seclude the ¿contaminants¿ and identify the extend of impact in order to prevent any other possible pollution events as soon as possible. . Operator decided that more in depth investigation/cleanup would continue/completed after the holiday weekend. Lined sed trap&dug sump pit at intial pt of discharge for wkn
1913085 2010-09-07 Outstanding Violations - No Viols Req'd operator was pushing rock back off top of pad in area `believed¿ to be affected by `unknown substance.operator was unaware of source of pollutant substance and/or extends of area of impaction. operator dug a sump pit and ditch on top of pad( approximately 75 from initially noted discharge point) in hopes that ¿contaminant¿ would flow into sump pit (unlined) and be vacuumed by McCutcheon. Once ditch and pit were dug it subsequently filled with an oily substance and water. observed that operator dug to and below geo-textile level of pad, at this point it appeared the only barrier between ¿contaminant¿ and groundwater table and soil was a layer of clay, which operator deemed to be strong enough that permeability was not considered an issue. operators plan of attack was to continue to attempt to direct flow of ¿contaminant¿ toward sump pit and or dig additional ditches and pits to collect material that could be vacuumed by McCutcheon, prior to excavating the contaminated soils. operator did not have plans to work 24hrs on clean up process.
1913091 2010-09-09 Outstanding Violations - No Viols Req'd operator was still continuing to vacuum ¿contaminant¿ out of sump ditch and pit. Operator, noted that they had some assumptions and were investigating some leads as to what may have happened, but no specifics were divulged at this inspection. Again, source and definite area of impact were not yet identifiable. Matt Barch, stated that they believed they have the release contained to a generalized area on the pad, and upon visual observation when it appears all liquid fraction has been removed; removal of soil would begin. operator believed that they had the release contained onsite and did not forsee any additional possible pollution events It is not believe that all liquid contaminant has been removed to date as there was evidence that seep continued. Operator game plan was to proceed with excavation and place all contaminated soils/rocks etc in lined dumpster provided my McCutcheon when ¿liquid¿ contaminant appeared visual removed. Streams samples from a small intermittent stream located near well site were collected. Accompanied by MRPS Jim Kline
1913096 2010-09-13 Outstanding Violations - No Viols Req'd visual observation appeared that operator had removed impacted soils and liquid fraction related to unknown release. Matt Barch, stated cleanup ceased; to point of visual observed that all contaminants were removed, on Sept 11, 2010. Environmental consultant (Cummings Riter Consultants Inc) was hired by the company and arrived on site on Sept 10, 2010. Cummings began coordinating cleanup efforts. Post cleanup soil samples have not yet been taken by operator to confirm that all contaminants have been removed. During this inspection Ed Bates (ECUP) split a soil sample with Chief. collaboratively determined by parties involved that a sampling plan would be devised and approved by Ed Bates prior to final restoration Chief believes that release is related to drilling operations, but they are continuing their investigation and will provide a narrative to dept on final investigative findings.3 Chief reps(Matt B, Lou s, Mike H), 1 Cumming Riter Consultant (Pat O), myself Ed Ritzer, Ed Bates (DEP)
1913701 2010-09-17 Outstanding Violations - No Viols Req'd , operator actively placing contaminated materials in dumpsters for final disposal. During a visual inspection of previously impacted area, I was unable to detect or observe any oily substance, residue, or seep as related to initial discharge, but post excavation sample results are pending (9/13/10). Noted that operator was having the ¿excavated area¿ vacuumed out in order to remove rain water that had accumulated. Department received an interim copy of post excavation sampling plan on 09-16-10, while onsite today observed delineated points of sampling. Department also received stream sampling results with OG detection of 5.7 mg/l downstream and upstream <5.0mg/l. Chief had plans to resample prior to 9-16-10 rain event. Dept recommended that sub contracting crew onsite properly clean all equipment used to transport material in to dumpsters prior to moving around well site (uncontaminated areas )in order to prevent a possible pollution event. Corrective actions measures are ongoing at this time
1922574 2010-10-13 Outstanding Violations - No Viols Req'd Operator and DEP are cooperatively and actively working to remediate and cleanup a violation issued for areas previously impacted by a large release of an unknown product, which appears to possibly be petroleum based, yet to be determined by operator. Dept has been promptly receiving soil analysis results and/or updates of remediation process from operator. Dept was recently notified that operator has plans to conduct a second round of excavation of previously impacted areas based on latest sample results that indicated some sample point results were outside of the acceptable limits discussed/ agreed to with the Dept. Noted that surface water accumulated in excavated area. It also appears that additional rock was added to pad outside of excavated area. No accelerated erosion or sedimentation issues were noted in relation to access road or well site Upon FINAL remediation operator agreed to supply dept with timeline of activities of details of cleanup, release source and cause. 1934509 2010-11-10 Outstanding Violations - No Viols Req'd Follow up inspection, of final cleanup measures being taken from a released detected in June 2010. Site properly signed with Es plan and 24hr security. Areas previously delineated to be impacted by the unreported release appear to been excavation, disposed of and backfilled. It is noted that area were initial discharge was detected has not yet been seeded an/or mulched. Currently dept is awaiting final restoration activities as well as a narrative describing the events of the release and cleanup. No additional violations or accelerated ES issues were noted, nor was there visible evidence of a discharge or seep at this time. Spoke to Matt Barch via telephone whom stated he was working on a narrative for WQS supervisor Ed Ritzer and that site would be seeded and mulch fairly soon. A follow with operator is planned for next month.

2006205 2011-09-28 No Violations Noted At the time of inspection, drilling equipment was removed from site. No E&S or IW issues. Well head was completed with well head manifold. No pressure reading on the gauge located at the manifold. Annulus valve was closed.
1944422 2011-01-05 No Violations Noted Site sign and ES plan present. 24hr Security guard onsite. Noted that pad has been fully restored with adequate fill. Vegetative mat, little growth observed, has been placed on slope along side of pad where original seep observed. At this time, there did not appear to be any visible evidence of a continuing seep/release; It appears that operator has removed all contaminated/impacted soils/materials onsite impacted by the unknown release, later ¿confirmed [by Chief] that the drilling company had and unreported release of approximately 110 gallons of hydraulic fluid during the drilling process.¿ All temporary bmp¿s outlined in ES plan are in place and remain until final permanent restoration of site is achieved. Noted that two disposal tanks were located onsite. Well head and site are surrounded by fencing. Dept is recommending that operator routinely monitor all bmp¿s as well as vegetative growth in area of original seep.

2069373 2012-05-10 No Violations Noted At the time of this inspection, site Id sign, Es plan, ESCGP-1, and PPC plan onsite. Site gated and monitored by 24hr security. Multi well pad. Said well previously drilled. Crown Rig # 8 actively drilling 6H. Charles, DSM onsite during this inspection. Secondary containment in place beneath rig and onsite tanks. No pits installed by Chevron for drilling operations. Tanks and secondary containment look structurally sound. Appears bmp's are installed and functioning according to plan. No accelerated erosion or sedimentation issues noted with site or access road. Access road adequately rocked.Noted a "small" leak coming from Residual waste box on site, notified DSM whom stated the problem would be addressed immediately. Absorbent pads were placed in location of leak. Department also noted to DSM of a possible safety concern near back side of rig, where it appears shale was placed over top electric lines and drilling equipment (see picture). DSM stated that matter would be addressed immediately/ No violations noted.
