The E&S plan is adequate and BMP were properly implemented and maintained. The Department notes two impoundments directly adjoining the well pad area were observed. One was lined and had the appropriate amount of freeboard and the other pit was being constructed at the time of inspection.

2080827 Primary Facility 2012-06-20 Incident- Response to Accident or Event In Compliance with Policy On June 20 2012 at 11:30 the Operator contacted the Department to report a spill at the impoundment associated with this well. The spill originated, as indicated by the operator, from the truck man way that had not been properly closed. The spill consist of 15 gallons of flow back water. The Operator indicated that the spill was immediately cleaned up with absorbent pads and an excavator located onsite. At this time the Operator is in compliance with the spill policy set forth by the Department.
2080829 Primary Facility 2012-06-25 Follow-up Inspection Pending Follow up inspection related to the spill report received on 6/20/2012. At the time of inspection the Department could not easily observe the affected area because the site had been backfilled with clean durable rock. The Department suggest the Operator excavate and take soil samples of the area to ensure the area has been cleared of any pollutional substance. The Department suggest that the Operator take advantage of secondary containment when dealing with flow back i.e. parking pump trucks containing flow back water on containment to prevent future spills.
