2792789 Primary Facility 2018-10-22 Complaint Inspection Violation(s) Noted A complaint was received by the Department on 10/20/18 alleging a spill occurred at the Newcomer 1 gas well on 10/18/18. The complainant alleged the brine tank was removed and the brine was intentionally released onto the ground, causing grass to be killed. No spill was reported by the Operator.

On 10/22/18 at approximately 1200 hours I, along with Environmental Protection Specialist Kevin Maskol, conducted an inspection of the site. Dead vegetation and soil discoloration were immediately apparent. An odor was also observed near the impacted area. The release appeared to have occurred adjacent to the brine tank pad site and followed a tire track depression as it flowed down slope.

The location where the brine tank had been situated contained what appeared to be rain water that was impacted by brine. Field screenings for conductivity in the tank site showed conductivity levels of 12.3 mS. 2793763 Primary Facility 2018-10-23 Routine/Complete Inspection No Violations Noted On site inspection shows well head capable of production, and appears to have valves open for production. Open annuli loaded with water show no gas bubbling.

Surface equipment appears capable of production although a tank has been recently removed (see WQS inspection with violations), and there is no chart on the meter recorder.

Enough plumbing and pipe is buried to make it uncertain if the well is open to another gathering line or shut in.

2801643 Primary Facility 2018-11-06 Follow-up Inspection No Violations Noted On 11/06/18 at approximately 1100 I conducted a follow up inspection, due to outstanding violations. The spill area appeared to have been remediated, but the Department has not received confirmatory sample results from Diversified. The area appeared to be seeded and mulched and was free of erosion.

Gas appeared to be leaking from a pipe in the brine tank pit. It is recommended the leak be addressed.

2824358 Primary Facility 2019-01-09 Follow-up Inspection Violation(s) Noted Follow up inspection to Water Quality Specialist inspection dated 11/6/18, inspection record # 2801643. On site inspection shows gas venting uncontrolled. WQS filed report on 11/6/18 noting that the gas leak in brine tank pit needs addressed. Well continues to vent. Natural gas confirmed with Altair 5X multi-gas detector. VIOL
2824483 Primary Facility 2019-01-09 Routine/Complete Inspection No Violations Noted On 01/09/19 at approximately 0715 hours I, along with Environmental Group Manager Dave McDermott, conducted a routine complete inspection at the site.

The remediated area had proper temporary stabilization. There were no signs of erosion observed.

The gas leak noted on 11/06/18 had not been addressed. The pipe within the brine tank pit appeared to still be leaking gas. Oil and Gas Inspector Eric Peterson was notified and will be completing an additional inspection.
