Culvert pipe nearest the AR gate appears to be filled with sediment. As a result, it appears that the water intended for the culvet pipe is flooding the roadway creating erosion gullies. Dept contacted Opr Rep Spenser Johnson by phone. Opr stated he would send a field rep out immediately.Opr Rep Richie Vrobel contacted Dept by phone at 15:53. He stated the culvert was cleaned and water was running through it. Opr was sending field personel out tomorrow (2-5-16) to do additional work at/near culvert and along AR in order to ensure culvert pipe is functioning properly. Opr intends to utilize heavy equipment to fix road when weather improves. Dept recommends Opr continue to monitor and maintain AR. A follow up inspection will be conducted to ensure culvert pipe is functioning properly and E&S issues are addressed.Violations being issued for failure to maintain BMP's and for failure to minimize accerated erosion and sedimentation.

At time of inspection culvert pipe appears cleaned out and appears functional. No water crossing access road at or near culvert pipe. Department recommends Operator continue to monitor and maintain access road and culvert pipe to avoid any E&S issues. A follow up inspection will be conducted at a later date. Violations are still outstanding for this site.

RTPT inspection to Inspection Record #2448023 where violation issued for failure to maintain BMP's and failure to minimize erosion/sedimentation.

Present during inspection: CNX Foreman Richie Vrobel, CNX Reps Will Roupe and Alex Molnar, DEP Biologist Supervisor Mike Stephan and DEP Biologist Will Brogan. Operator outlined projected plans for replacing current culvert which failed causing violations to be issued on 2-4-16. Operator intends to install larger culvert pipe and add additional rock to AR near culvert area. Operator requested clarification on what, if any, permits would be needed. Operator also hoped to have permit process expedited because of outstanding violation. Biologist Mike Stephan stated submitted plans would be reviewed, possibly expedited. Department received GP-7 from Operator on 5-27-16. DEP Biologists are in the process of reviewing the permit.

2493413 Primary Facility 2016-06-09 Administrative/File Review Outstanding Violations - No Viols Req'd Admin inspection to inspection record # 2448023 where violations issued for failure to maintain BMP's and failure to minimize erosion/sedimentation.

Operator submitted GP-7 to Southwest District Office Oil and Gas Operations Tech Services on 5-9-16. After a technical review of the GP-7 DEP Biologist Supervisor Mike Stephan recommended on 6-10-16 that the GP-7 be withdrawn and Operator submit a PASPGP-4 with a Waiver letter to the Army Corps of Engineers. Department awaiting Operator response. UPDATE: 6-13-16: Operator responded to Biologist via e-mail requesting the GP-7 be withdrawn and will proceed with the PASPGP-4.

2500644 Primary Facility 2016-07-08 Administrative/File Review In Compliance with Policy ADMIN inspection to inspection record #2448023 where violations were issued for failure to maintain BMP’s and failure to minimize erosion and sedimentation.

Department contacted Operator Rep Richie Vrobel by phone to request update on status of culvert pipe replacement. Mr. Vrobel stated he was at the site this past Tuesday (7-5-16) for a site meeting with contractors. Bids on the replacement of the culvert pipe are due on 7-12-16. He hopes work will begin in 3-4 weeks. Department requested copy of permit CNX received. Mr. Vrobel stated he would e-mail a copy to Department. UPDATE: Department received copy of PASPGP-4 via e-mail. A follow up inspection will be conducted at a later date to ensure permit requirements are being met. Previously issued violations for this site have been scheduled for correction. Operator appears to be In Compliance with Policy at this time.

2508702 Primary Facility 2016-08-05 Administrative/File Review Outstanding Violations - No Viols Req'd Admin Inspection to inspection record # 2448023 where violations issued for failure to maintain BMP's and failure to minimize erosion/sedimentation.

2520368 Primary Facility 2016-09-07 Compliance Evaluation No Violations Noted Compliance Evaluation Inspection to inspection record #2448023 where violations issued for Operator failure to maintain E&S BMP's.

At time of inspection E&S plan on site. Entrance to gated access road rocked. Temporary BMP's installed around disturbed area and area appears to be seeded and mulched. No E&S issues observed on access road. It appears an 18" culvert pipe has been installed and a stilling pool has been constructed at the inlet of the culvert pipe, matching the E&S plan, and the approved GP. According to E&S manual, stilling pool should be constructed at outlet of culvert pipe. However, GP was approved (see attached e-mail) with this BMP at the inlet, and a riprap apron at the outlet. Compost silt sock has been installed and appears adequate. Disturbed areas appear to be seeded and mulched. Department recommends Operator remove temporary BMP's when permanent stabilization has been achieved. A follow up inspection will be conducted to ensure permanent stabilization is achieved. At time of inspection E&S plan on site. No E&S issues observed on gated access road. Temporary BMP's (compost filter sock) still on site. Disturbed areas vegetated but do not appear to have reached >70% uniform vegetative growth. Department recommends Operator remove temporary BMP's once permanent stabilization has been achieved. Stilling basin and rip rap apron appear adequate. At this time no water is running through culvert pipe. A follow up inspection will be conducted to ensure permanent stabilization is achieved.
