Operator rep Sam Kimmel contacted Department by phone. Mr. Kimmel stated he was aware that he was late in responding to the NOV and that his response will be emailed to the WQS in the near future. Mr. Kimmel stated that no E and S plan was developed because no earth disturbance was conducted. No pit was dug; all fluids/materials normally placed into a pit when plugging were contained in tanks manifolded together. All plugging equipment was then removed and the site was seeded and mulched. A follow up inspection will be conducted at a later date. |

According to operator (see inspection record #2686894), during plugging operations holding tanks were used in lieu of earthen pits. Operator also stated no earth disturbance activities were required during the plugging. Because of this, no E and S plan was created. At time of inspection, no E and S issues observed on access road or site. Access road and site appear to be mulched. Department unable to determine if any earth disturbance has taken place on site however site appears temporarily stabilized with no E and S issues. Based on operator response and today's inspection, operator appears to be in compliance at this time. Violation issued under 102.4 (b)2 has been closed. |
