ON 12/13/2016 AT 1323, A RELEASE OF 13 BBL BRINE WATER WAS REPORTED TO SWRO REPRESENTATIVE D.J. STEVENSON BY OPERATOR REPRESENTATIVE ERIK GREENERT. RELEASE OCCURRED AND/OR DISCOVERED ON 12/13/2016 AT 1120. NO WATERWAYS ARE REPORTED TO BE AFFECTED.

2545023 Primary Facility 2016-12-13 Administrative/File Review In Compliance with Policy Admin inspection conducted in response to inspection ID 2544979 for the reportable release of 13 bbl brine water.

Upon receipt of spill report, Department contacted Operator representative Erik Greenert via phone at 1400. Per Mr. Greenert, a gasket on the bottom of the poly brine tank deteriorated, which resulted in a drip that released a total of 13 bbl brine water to the ground before being discovered by the well-tender. The well was last inspected by the well-tender in mid-November, therefore it is believed that the drip began no earlier than mid-November. The quantity released was determined by tank level readings. Mr. Greenert reports that, based on conductivity readings, the release extends approximately 3 feet out from the valve and then extends around the side to the back of the tank. There are no standing fluids on-site, therefore, it is believed that the brine water has saturated into the ground. No nearby waterways are reported to have been impacted. 2545103 Primary Facility 2016-12-14 Incident- Response to Accident or Event Violation(s) Noted On-site inspection conducted in response to admin inspection 2544979 for the reportable release of 13 bbl brine water to the ground.

At time of inspection, well-tender Jeff Heilburn and contractors on-site. Excavation of contaminated materials not yet commenced. Due to snow-cover, the Department was unable to observe the area impacted by the release. Per Mr. Heilburn: No snow was on-site yesterday (12/13) when the spill was discovered. The release appeared to extend to the right of the brine tank when standing at the well head. The release of 13 bbl brine water resulted from a corroded valve on the brine tank. While on-site, contractors moved brine tank in preparation for excavation of impacted soils. Two roll-off boxes on-site. Department recommends Operator properly install temporary E&S BMPs as necessary in order to prevent any potential pollution events from occurring. Access road has been plowed. 2547547 Primary Facility 2016-12-27 Follow-up Inspection Pending On-site FUI conducted in response to violations issued under inspection ID 2545103 (enf ID 349428) for the 12/13/2016 reportable release of 13 bbl brine water to the ground.

At the time of inspection, area of excavation not yet backfilled and surrounded by orange security fence. Area of excavation is located adjacent to the wellhead. Within the area of excavation, Department observed what appears to be a torn black liner, which could be indicative of a compromised encapsulated drill pit. No other materials (i.e. potentially encapsulated materials) were observed at this time. The Department is requesting the Operator investigate to determine the location of pit encapsulation and burial and notify the Department of findings. Brine tank remains disconnected and on-site. At 0910, the Department notified Operator representative Erik Greenert via phone of observations noted in inspection record 2547547 of what appears to be a torn black liner within the area of excavation, which could be indicative of a compromised encapsulated drill pit. Mr. Greenert does not believe the drill pit was compromised by the excavation, but anticipates conducting an on-site investigation tomorrow (12/29). At 1531, Department spoke to Operator representative Erik Greenert via phone as a follow-up to admin inspection 2547564 in which the Department notified Mr. Greenert of what appears to be a torn black liner within the area of excavation, which could be indicative of a compromised encapsulated drill pit. According to Mr. Greenert, he conducted an on-site inspection following the Department’s notification of this observation. Based upon his observations, Mr. Greenert does not believe that an encapsulated drill pit was compromised. Further investigation to be performed (i.e. review of E&S plan, restoration report). Violations issued under inspection ID 2545103 (enf ID 349428) remain outstanding.

The Department reviewed the restoration report for this well site as the Department previously observed a torn black liner within the area of excavation, which could be indicative of a compromised encapsulated drill pit. Per the restoration report, no materials were encapsulated on-site as drill cuttings were land-applied. Therefore it does not appear that the “material” (i.e. black plastic) revealed during spill remediation was that of a previously encapsulated drill pit. Violations issued under inspection ID 2545103 (enf ID 349428) remain outstanding.
