Tanks and containment appear structurally sound. Access road adequately rocked and no accelerated E&S issues were noted.Department recommends that Operator remove debris from rock-lined ditches.

Well tag present and legible. Brine tank located in secondary containment. At this time approx 10 inches of liquid located in secondary containment. Department observed a hose discharging fluids from tank secondary containment onto well pad. This hose begins in bottom of secondary containment, goes over containment wall, and ends on rocked area of well pad. No oil/sheen was observed on fluid located in containment or on/around fluid released onto pad. No erosion gullies or ponding of water was observed near discharge point. Department recorded a pH of 8.7 and specific conductivity of 1595 microsemens/cm from water sample taken from containment area and a pH of 8.6 and specific conductivity of 1595 microsemens/cm from water sample taken from discharging hose. Operator Rep Clayton Hill contacted Department by phone. Mr. Hill requested clarification on the violation issued for failure to properly store, transport, process or dispose of a residual waste. Department stated that the violation was issued because production fluid was moved from one site (the Allen) to another site (the Saylor). Mr. Hill stated they were bringing the Saylor Unit 2H well online and used the produced fluid to assist in setting pipe down hole. Mr. Hill offered to provide disposal manifests from the Saylor well. Department received response to NOV from Operator. In response to the violation issued under 78a.60 DISHCHARGE REQUIREMENTS, Operator states that a new freshwater discharge plan has been implemented and new pH and conductivity meters purchased. In addition, Operator has increased employee training regarding 78a regulations. Department recommends Operator conduct field tests to ensure the soils where the top-hole release occurred are not contaminated. Department requests Operator provide Department with results when results are obtained.

As per previous inspection (inspection record #2568069), Department requested field tests be performed to ensure soil where top-hole release occurred are not contaminated. At the time of this inspection Department has not received those results. Department contacted Operator by phone and left message requesting sample results. Operator Rep. Clayton Hill responded and sent sample results via e-mail.

Previously issued violation for land applied top-hole water that does not meet requirements for pH, conductivity, and sheen remains outstanding. Other violations issued under inspection record #2549

In response to the Department's questions, Mr. Hill stated that a background sample was not collected, a sample of the fluid released was not collected, and that coordinates of where the grab sample was collected were not recorded. The Operator remains responsible for any E&S issues that develop on the access road and well pad, even if landowner activity results in those E&S issues.
