The Operator is in compliance with the Departments notification policy for a BMP breach. During the inspection the Department notes that an infiltration ditch located closest to the access road failed during a heavy precipitation event in the early morning hours on 6/13/2013. The failure resulted in material from the infiltration ditch being washed into a 32" silt sox, which did not contain the material and also failed. The two failures resulted is accelerated erosion of the access road and scouring of a hillside below the excavated pad area. The precipitation event appears to exceed the Departments criteria for construction standards. The Operators response was to rebuild the failed portion of the infiltration ditch, add an additional rock outlet and repair the silt sox. The Department suggests the Operator continue to monitor the site weekly and after significant precipitation events to ensure the stability of the site is maintained.

Department met with Operator on site to review site conditions and inspect small earth slip. At the time of Department inspection, no pad expansion work had commenced. The scope of this expansion project involves disturbing less than 5 acres of land and is covered under an E&S plan. Work area has been staked. Department observed the slip area, which appears to be localized. Operator to repair this during the pad expansion work.
