The Operator is in compliance with the Departments notification policy for a BMP breach. During the inspection the Department notes that an infiltration ditch located closest to the access road failed during a heavy precipitation event in the early morning hours on 6/13/2013. The failure resulted in material from the infiltration ditch being washed into a 32" silt sox, which did not contain the material and also failed. The two failures resulted is accelerated erosion of the access road and scouring of a hillside below the excavated pad area. The precipitation event appears to exceed the Departments criteria for construction standards. The Operators response was to rebuild the failed portion of the infiltration ditch, add an additional rock outlet and repair the silt sox. The Department suggests the Operator continue to monitor the site weekly and after significant precipitation events to ensure the stability of the site is maintained.

2253170 Primary Facility 2014-03-13 Incident- Response to Accident or Event No Violations Noted Incident inspection the result of a 2 gallon motor oil spill reported by the Operator on 3/12/2014. The Operator is in compliance with the spill policy. During an onsite inspection the Operator indicated the spill occurred during a maintenance break. The Operator indicated that a mechanic spilled the motor oil while preforming routine maintenance on an engine located on top of containment. The continent was full of precipitation and the motor oil was suspended on the water, which results in a portion of the oil reaching a portion of the pad. The Operator immediately added spill booms and vacuumed the affected area. At the time of inspection the Department did not visually observe any threat to the environment associated with this spill. The Department suggest the operator take confirmatory samples and background samples to ensure the spill was properly remediated.
