However, the tank was filled to capacity and approximately 50 gallons discharged onto the ground surface. The spill was contained to the pad. Five + yards of impacted soil were excavated, staged on and covered with plastic sheeting. Discharging residual waste onto the ground, which in turn is a threat to the waters of the Commonwealth, is a violation of the statues listed above. However, since this incident was immediately reported and the affected soil was promptly excavated, these violations may be considered immediately resolved. 567698
