| The Department was at the above referenced Marcellus Well to conduct an inspection after receiving a complaint in regards to frac water being spilled over the site.  The Department met the land owner on site and he explained the situation.  The Department also spoke with Contractors and the Operator in regards to the pollution incident.  A Contractor was pumping and treating flow-back/frac water and in the process, lost approximately 5 barrels of contaminated water. The water spilled on site and ran over the fill side of the site reaching the silt fence.  The Contractor on site placed straw bales down gradient of the spill to mitigate the contamination.  The Contractor was also going to excavate any soil that may have been contaminated by the spill and place in roll-off containers to be hauled to the landfill.  The site is sliding on the opposite side from the spill.  Sediment has gotten through the E/S controls and needs to be addressed.  The site needs to be stabilized as soon as possible.

BRONCO 37 RIGGING UP. PRE SPUD SAFETY MEETING WAS CALLED WITH THE DEP TO ADDRESS CONCERNS. CHEMICALS ARE NOW BEING KEPT IN A DIKE. BRONCO WILL NOW BE DRILLING WITH A CLOSED LOOP SYSTEM. CREWS HAVE BEEN DOING MAINTAINANCE FOR SEVERAL DAYS. RIG AND SITE BOTH LOOK GREAT.

1933188 2010-12-01 Violation(s) Noted The Department was at the above referenced Marcellus Well to conduct an inspection after receiving a complaint in regards to frac water being spilled over the site. The Department met the land owner on site and he explained the situation. The Department also spoke with Contractors and the Operator in regards to the pollution incident. A Contractor was pumping and treating flow-back/frac water and in the process, lost approximately 5 barrels of contaminated water. The water spilled on site and ran over the fill side of the site reaching the silt fence. The Contractor on site placed straw bales down gradient of the spill to mitigate the contamination. The Contractor was also going to excavate any soil that may have been contaminated by the spill and place in roll-off containers to be hauled to the landfill. The site is sliding on the opposite side from the spill. Sediment has gotten through the E/S controls and needs to be addressed. The site needs to be stabilized as soon as possible. 601068 78.54 - Failure to properly control or dispose of industrial or residual waste to prevent pollution of the waters of the Commonwealth.
