1970307 2011-05-03 Outstanding Violations - No Viols Req'd On May 4, 2011, I stopped at the Rice¿s Hulk site in Amwell Township to check on their progress towards addressing the problems found earlier in the year.

Because of the exceptionally wet spring, Rice has been able to do very little in the way of addressing the problems. Some BMPs were installed and some seeding was done. Also, a surveying team was on-site taking measurements to address the two slips.

1995788 2011-05-18 Outstanding Violations - No Viols Req'd On May 18, 2011, I stopped at the progress at Rice¿s Hulk site. Very little work was done on site, again because of the wet weather. I noticed the pipeline area was cleared but work had not yet started. I also noticed the water in the freshwater impoundment was nearly above the 2-foot freeboard allowed.

I called Dave Miller and we talked about the work and the freeboard issue. He told me he would watch the impoundment¿s water level. He also told me that the plans for the slides were in the final engineering stages and that they would be submitted to the Department soon.

1995811 2011-06-09 Outstanding Violations - No Viols Req'd On June 9, 2011, I stopped to check on the progress of the 10 Mile Creek to Hulk section of pipeline.

1) Still no E&S Plan on site (there was one for the X-Man to 10 Mile Creek section.

2) The silt fence was down by the corn field.

3) There are ruts and mud throughout the right-of-way.

4) The silt fence is still not installed properly.

5) Many of the breakers on the pipeline right-of-way going up the hill from 10 Mile Creek are washed out.

6) The re-vegetation is very sparse and in some areas it looks like it wasn¿t reseeded at all.

7) At the top of the hill it appears not to be seeded at all and there is a 200 yard area with no breakers in it.

8) In the water withdrawal area (from 10 Mile Creek) some of the E&S controls have not been maintained and now have holes or are knocked down.

I called Dave Miller about these problems told him they needed worked on.

1995828 2011-06-30 Outstanding Violations - No Viols Req'd On June 30, 2011 I stopped at the Hulk pad to gauge progress. The original stream crossing was repaired but the sediment fence near the 10 Mile Creek withdrawal area was still down.
1995883 2011-07-29 Outstanding Violations - No Viols Req'd Inspected the site with Water Quality specialist Supervisor, Vince Yantko. Some progress on original problems but others need addressed. There appears to be no E&S plan for the Hulk fresh water impoundment to Hulk pad part of the pipeline. We talked with Dave Miller and Well Tech personnel.

The drilling company (East Coast Underground) was on-site trying to pull a plastic pipe through the hole they drilled.

There was still not plan or the Little Ten Mile to Hulk pipe line segment and crossing.

This inspection closes out the original Hulk violations covered by the March 21, 2011 NOV. There are still NOVs associated with this site and related pipeline that will be closed separately.
2022766 2011-11-02 Outstanding Violations - No Viols Req'd At inspection Rice's contractor wsa putting geofabric and rock down on the access road.

The pipeline was seeded and mulched as was the extra entrance. I also suggested that the extra entrance be roped off to keep vehicles off of it.

The area is better but work still needs to be done.

On October 20, 2011, the Department regeistered GP 056311830 & GP08630711-003 for both the utility crossings and the Hulk/Captain Planet area. These permits are on site.

The area is currenlty in compliance. Rice is responsible to maintain the site stabilization, weekly and percipitation event inspections, E&S maintenance and additional installation as needed, as well as all the other conditions in any permit that applies.

Final enforcement action is still pending.
