       adequate freeboard).  Topsoil remains stock-piled on the side of the site.  No backfilling has occurred.  Very little vegetation on site.   
       No seeding/mulching has been done.  Failed to comply with terms and conditions of permit as the E&S plan submitted with the waiver application was not carried out on the site.  Failure to minimize accelerated erosion, implement E&S plan, and maintain E&S controls.  Silt fence was down and there were signs of accelerated eros.
