Mike Gatskey and the E&S plan drawing will be revised to show filter fabric fence backed with hay bales.  Noted that the seasonal high groundwater table was at a depth of between 17 and 22 inches.  At this shallow depth a below grade pit would only be able to utilized during the dry time of the year, as outlined in 78.56a(4)(iii) and 78.56b.  In addition due to the shallow depth to the seasonal high groundwater table encapsulation of the drill cuttings is not available as an option to dispose of said cuttings.  Also land applicationofor disposal of cuttings is available only if the if the seasonal high groundwater table is at least 20 inches from the surface.  At this time the Department is requesting that the operator revise and submit the E&S plan and waiver application to show a method of disposal for the drill cuttings by the date given on the accompanying letter.
