I found all the frac tanks that had been stored near the impoundment area have been removed , the contaminated soil by leaking frac has been removed and company has extended the stone pad for facility over area soil had been removed , there has been a murphy switch installed on the pressure side of the injection pump . Upon further insection I found the earthen dike wall around the storage facility was not of a sufficient height where the steps go over the dike wall leading into the pump house . I contacted Bob Barnett by telephone and told him he had to raise the earthen dike wall where the steps go over the dike wall . He in turn told me he would have the dike wall raised by Monday 2-24-2014 and would contact me when remedial the work was completed .

There was brine dripping onto the ground from the heater tube on this same tank at the time I was performing my inspection . I looked inside the leaking tank to find the fluid level just above the heater tube . Further inspection of the frac tanks I found two more of the tanks were half full of fluid . Upon further inspection of the pump station I found there is no automatic shut-off device on the injection line from the injection pump to shut-down the injection pump if the maximum allowable injection pressure is exceeded . The injection pump was in operation at the time of my inspection . REMEDIAL WORK REQUIRED TO RESOLVE COMPLIANCE NOTICE : REMOVE CONTAMINATED SOILS AND DISPOSE OF IN AN APPROVED MANNER , REPLACE REMOVED SOILS AND ESTABILSH AND MAINTAIN VEGETATION GROWTH , INSTALL A WORKING AUTOMATIC SHUT-OFF DEVICE ON THE PRESSURE SIDE OF THE INJECTION PUMP , REMOVE ALL FLUIDS BEING STORED IN THE 300 BARREL FRAC TANKS , REMOVE ALL TANKS NOT BEING PROTECTED BY A IMPOUNDMENT TO PREVENT A SPILL .
