2083861 2012-07-11 Violation(s) Noted Well spudded 7/9/12. At the time of this inspection, Well Id sign, permit, and ES plan present. Aces road entrance adequately rocked. It appear that access road culvert have not been properly stabilized with rock and/or vegetative growth; therefore, department is recommending that operator add a temporary stabilization to culvert ditches and outlets in order to prevent a possible pollution event. No accelerated erosion or sedimentation concerns were noted on access road, but the Potential exists hence site recently constructed. Bmp's installed according to plan down gradient from well pad (i.e. filter fence). One lined below grade pit located onsite-- according to ES plan an above grade pit was to be used due to depth to seasonal high groundwater table. Soils type primarily Cookport- department is going to further investigate soil type and determine minimum depth of groundwater table for designated soil type, until that information is verified Inspt result will remain pending, no accelerated ES at time of this inspection. 644333 78.56PITCNST - Impoundment not structurally sound, impermeable, 3rd party protected, greater than 20" of seasonal high ground water table
2084915 2012-07-19 Violation(s) & Outstanding Violations during todays inspection, it was observed that operator failed to properly install/maintain culvert ditches and outlets; therefore, a new violation is being written for failure to minimize erosion and sedimenation again for failure to design, implement and maintain ES BMP's as outline in ES plan.Operator has crew actively cleaning state road and access rd entrance at time of this inspection. Recommend that operator add additonal rock to access road in order to prevent a pollution event, as well as reduce the potential for mud reaching Peg Run Rd. Well drilled not yet equipped for prodcution. Drilling equipment actively being moved off site. One below grade lined pit with drill fluids and cuttings on site. Based on previous inspection and admin review of soil type violations were issued on previously pending report due minimum depth of seasonal high grounwater table. Operator shall remove all pit contents (fluids, cuttings, and liner) and properly dispose at an offsite facility. Department is requesting that all manifests and disposal records be provided to the department upon final disposition of waste.It was observed that operator failed to properly install/maintain culvert ditches and outlets and since last inspection it does not appear that necessary measures were taken to prevent accelerated erosion events along access road; therefore previously issued violations are outstanding. 2093211 2012-07-16 No Violations Noted Well Id sign and E&S plan were present at access road. At the time of the inspection, no E&S concerns and no freeboard issues were present at the site. NTS contracted First Class to complete the gas well. Conductor pipe (20ï¾”) was set at 34 ft. and was sanded in. 9 5/8ï¾” pipe was set at 673 feet. On 7/11/12, first cement was completed with 250 sks of Type I and no return. . Second cement job occurred on 7/14/12 and used 100 sks of Class A and 40 sks of Sypersubtropic with 80 lbs. of Bara seal. Cement was recorded to surface. Surface pipe (7ï¾”) was set at 1179ï¾’ and was cemented with 186 sacks of Type 1 with 2 bbl. return. Plug was down at 7/15/12 at 8:40 hrs. Water was recorded at 230 feet and coal was recorded at 430 ft. to 434 ft. Current depth was 1,330 feet.
2093229 2012-07-23 No Violations Noted Well Id sign and E&S plan were present at access road. At the time of the inspection, no E&S concerns and no freeboard issues were present at the site. Well was completed and slight gas release from piping. DEP talked to owner of property. Access road showed signs of sediment on the township road.

One below grade lined pit with drill fluids and cuttings on site. Previously issued a violations for construction of pit within seasonal high ground water table, as operator failed to implement ES plan as designed-where an above grade pit and/or tanks were to be utilized. Again, as per previous inspection report operator shall remove all pit contents (fluids, cuttings, and liner) and properly dispose at an approved offsite facility. Department is requesting that all manifests and disposal records be provided to the department upon final disposition of waste. Outstanding violations for failure to properly install/maintain roadside culverts and outlets is outstanding- per today's inspection access road exhibits erosion and culvert outlets are "full" of sediment. Perimeter bmp's are installed and appear to be functioning. Site appears temporarily stabilized with rock and/or bmps.

At time of inspection, well drilled, not yet equipped for production. Site ID sign, drill permit, one frac tank on-site. Below-grade lined drill pit still on-site, contents include drill cuttings and fluids. Freeboard remains exceeded. Orange security fence surrounding pit compromised.

As stated in previous inspections, Operator shall remove all pit contents (fluids, cuttings, and liner) and properly dispose of at an approved off-site facility. Department is requesting that all manifests and disposal records be provided to the Department upon final disposition of waste. Access road extremely rutted with erosion gullies extending length of road.

Accelerated erosion occurring on fill slope to the immediate left of the well pad entrance when facing wellhead. Several areas of accelerated erosion continuing to mid-length of slope. No measures to permanently stabilize site have been taken.

2206544 2013-07-08 Outstanding Violations - No Viols Req'd Admin inspt. Department spoke to Operator representative Steve Phillips via phone to discuss violations issued under inspection record 2177803 for failure to maintain freeboard in drill pit, failure to submit well documents, and for failure to restore well site within nine months of date of TD.

Mr. Phillips stated he is in contact and must collaborate with PENNDOT prior to performing restoration activities at the site. He also stated work on the well has not yet been completed and that the pit fluids are pumped out regularly.

Mr. Phillips agreed to submit a written response to the Department as previously requested in the NOV.

Outstanding violations exist under PA CODE 25 78.56(iii), 102.4, 102.11, 78.56(2), 78.65(3), 78.122, and 3216(c). No new violations noted that this time.

Department spoke to Operator representative Steve Phillips via phone to discuss violations issued under inspection record 2177803 for failure to maintain freeboard in drill pit, failure to submit well documents, and for failure to restore well site within nine months of date of TD and under inspection record 2199604 for failure to permanently stabilize site as per regulation to provide protection from accelerated erosion and sedimentation.

Mr. Phillips stated that Waste Management is currently emptying all pit contents and removing the pit liner. Mr. Phillips agreed to submit all manifests and disposal records to the Department upon final disposition of waste as previously requested in the NOV.

Upon removal of the pit, activities to reclaim the site and maintain the access road will commence.

Outstanding violations exist under PA CODE 25 78.56(iii), 102.4, 102.11, 78.56(2), 78.65(3), 78.122, and 3216(c). No new violations noted that this time.

At time of inspection, well drilled, not yet equipped for production. Site ID sign, drill permit, one Dumpster on-site.

Drill pit backfilled. Department still awaiting previously requested manifest and disposal records of pit liner and contents.

Perimeters of pad mulched, although erosion gullies still present on fill slope to the immediate left of the well pad entrance when facing wellhead (inspection record 2199604). Well pad not seeded/mulched for temporary stabilization. As per current regulation, Operator has four days from cessation of any earth disturbance activity to temporarily stabilize site.

Access road has been maintained, currently stable.

Outstanding violations still exist under 25 PA CODE 78.56(iii), 102.4, 102.11, 78.122, 78.65(3) and 58 PA CODE 3216(c). No new violations noted at this time.
