I suggested that he be proactive and contact Steve Opritza to get the situation straightened out. I reminded Terry that the rig has been sitting here for close to 4 years and he has to do something. He said that he was driving and he would call me back to get Steves number.

There was a string of lights hanging in the shanty. I could not tell by the condition of the tools if there has been any drilling recently, because they were hanging in the hole. The pit was still not re-lined and there was mostly dry drill cuttings in the bottom. There was some clear water in the pit, but there has been rain in the area recently. There are no records of a new drilling permit being issued for this well. I called Terry Helms and he didnt answer so I left a voice message.

0433536936 2018-10-17 Production Wells No Violations On the day of my inspection I found that the well was equipped with a pumping unit. The unit was in operation and powered with a gasoline engine. Terry Helms was at the site monitoring the well. Gene Matheny was rigged down and moving out from completing the well. Terry notified me two weeks ago that Producers was going to frack the well the week that I was out of town. Terry said that the well had only been pumping for a half hour when I arrived at the site. He had one of the drilling pits closed and he was starting to work on the other. The drilling rig and all associated materials had been moved out, and the site was graded out. There were no sags or visible holes in the liner and the fluid level was well below the top of the pit wall.
0461513606 2018-02-27 Drill / Deepen / Reopen No Violations On the day of my inspection I found that Helms Oil was drilling at a depth of 2475 feet. They were bailing the hole when I left the rig. There were no sags or holes in either pit liner. The fluid level in the first pit was staying below the top of the liner and the second pit still had plenty of room for fluid. The driller said that the water got ahead of them so they were back to one shift. I found no leaks or spills around the drilling rig or water tanks.

I did get notification recently that Terry Helms got his annual production reports up to date, but he still has other documents to submit before he can re-apply for a new drilling permit.
0599527270 2018-02-23 Production Wells No Violations On the day of my inspection I found that the dike was starting to fill up with water again, but it was not yet flowing over the front wall. The front wall of the dike had not been built up with soil. I called Clayton King and he said that he was out this morning at 08:30 to drain the dike down again and he would be back this afternoon. He claimed that he did get his skid loader moved to the site but he didnt build the front dike wall up because he plans to start removing material today. I did see the skid loader parked at the site. I recommended that he get another absorbent boom to put across the front of the dike until he gets done working on removing material. He said that he will try to get one.

0677106529 2017-04-10 Drill / Deepen / Reopen No Violations On the day of my inspection I found that the drilling rig was idle. There were no signs of recent activity. The tools were suspended in the hole. The pit liner still needs to be replaced. The pit is starting to collect rain water. Terry has a 1600 gallon poly tank at the drill site that has cracked open at the bottom. There was only 3 inches of fluid in the bottom, but it was high enough that there was some leaking onto the ground. There was a 12 to 15 inch area of oil/brine impacted soil in front of the hole. I called Terry Helms and told him the tank needs to be removed from the site and the contaminations needs to be cleaned up right away. I also told him that he needs to get the pit re-lined as soon as possible, regardless of whether or not his permit was expired. Finally, I questioned him again on his plans for the well. He said that he plans to finish it and claimed that all of his required documents have been submitted. I called Steve Opritza to ask if he had any information.
0724283547 2018-07-27 Preliminary Restoration No Violations On the day of my inspection I found that nothing had been done at the well site since my last inspection. The drilling rig and all the associated equipment and drilling materials were still at the site. The pits were still open. I did not find any holes in the liners. The upper pit was mostly full of drill cuttings with very little fluid on top. The lower pit had two or three feet of fluid in the bottom.

He said that he was trying to get everything out of here and he was trying to get on the schedule for Producers to frac the well. Terry said that he planned to leave the pits open until after the frac job to flow the well back.

He said that he wanted to leave the lower pit open for the frac job. Terry estimated that he would frac the well in the next four weeks.

I called Terry Helms to ask about his production reports. He still claims that his accountant has been sending them into the State. I called Jon Austin at Central Office to ask about the production reports. He went through his records and said that he has nothing after 2012.

The pit was still not lined and no permit was posted in the drilling rig. The pit was empty and There were no leaks or spills around the drill site. I contacted Terry Helms to remind him that he must have the pit lined and he must have a copy of the permit on location before he can run any casing. I also reminded him of his responsibility to provide adequate notification prior to running casing. I also informed him that I need proof that the casing was tested and that the casing must be centralized.

Steve Schultz was drilling for Terry. Steve said that he drilled an 8 inch diameter hole to a depth of 1130 feet and then reduced the hole to 6.5 inch diameter. He said that they would likely run the 7 inch diameter intermediate casing early next week. Steve said that the Berea was making some water and they were already through the black grit. There were no sags or holes in the new pit liner and there were no leaks or spills around the drill site. They had the re-issue drilling permit in the tool shed, so I asked Steve to get it posted in the shanty.

The fluid level was well below the top of the pit wall. The site still needs final grade and pit closure, but it is far to wet and muddy to bring in heavy equipment.
1233152096 2017-09-29 Drill / Deepen / Reopen No Violations On the day of my inspection I found that the drilling rig was still in place. The pit was still open, but the liner had not been replaced. There was no fluid in the pit, only dry drill cuttings. Most of the site was grown up in weeds and there were weeds growing up through the 7 inch diameter casing on the pipe racks. There were no signs that any recent drilling has taken place. I did find a small (less than 5 inches in diameter) puddle of rusty water below the load valve on one of the steel water tanks. I tested the water with a low range Quantab and found the chloride level to be below 250 parts per million. Terry Helms claims that the water in the tanks is fresh water that he had hauled in for drilling. The low presence of chlorides is likely due to residue in the bottom of the tank. The re-issued drilling permit has not been issued yet and Terry Helms has expressed that he has no desire to plug or sell the well.

He claimed that he intended to top it off in the next two days. I conducted a field test for chlorides with a low range Quantab. The water tested at 644 parts per million. There was no standing water around the tank. I called Terry Helms to report the issue. He claimed that the tanks were full of fresh water. I suggested that there may have been salt water residue in the tank that was mixing with the fresh water resulting in a positive test for chlorides. He said that he would be out to repair the leak or drain the tank.

1458567261 2016-03-21 Drill / Deepen / Reopen No Violations On the day of my inspection I found that the 100 barrel water tank was still leaking. It looked like there had been an attempt made to repair the leak. There was a small pin hole sized stream of water shooting out of the side of the tank. The puddle that had formed on the ground was frozen, but the water was still showing 644 parts per million chloride content. I called Terry Helms and told him that he must drain the tank to a level below the leak.

On this inspection the drill cuttings were heavily tracked from deer. There were also numerous small holes in the walls of the pit liner, presumably from the deer entering and exiting the drilling pit. I found no leaks or spills around the drill site. I called Terry Helms and told him again that he needs to start showing some drilling progress. I also told him that he must re-line the pit before he does any more drilling.

1486392970 2017-02-06 Drill / Deepen / Reopen No Violations On the day of my inspection I found that the drilling rig and all associated equipment was still set up on the location. The 7 inch casing was still on the rack. The pit liner had not been replaced. The material in the drilling pit was mostly dry. The drilling tools were suspended in the top of the hole. Terry has 1.5 inch orange plastic gas line ran from the existing tank battery to the drilling rig. I found a crack in the line that was blowing gas. I called Terry Helms, but he did not answer. I left a message reporting the gas leak, and I asked that he return my call to give an update on his intentions with the well. Terry did call me back. He claimed that he had the gas shut off to the rig, but he was having problems with Amish locals in regards to house gas, and he speculated that someone opened the valve. He said that he was just out there three days ago and everything was fine. He said that he would head out tonight after work to shut the gas off again. In regards to his plans for the drilling progress, Terry claimed that his accountant had sent in all of the production reports for past unreported years. He also claimed that he has insurance. I told him that I would call the main office to get some information.

There were no indications that any work had ben done to prepare to go back to drilling. Terry Helms still has not submitted the required documentation on previously drilled wells, and he has not obtained a re-issue drilling permit. Terry also has not obtained a plugging permit, or expressed any plans to sell the well.

The pit liner had not been replaced and the new spool of drilling line was still on the ground. I received a copy of the reissued drilling permit for this well dated 12/14/17. I called Terry Helms to ask what his plans were. He said that he had some work to do on the rig and he needed to get the pit re-lined. He then showed up at the drill site while I was still there. He started the rig and started his kiln. Terry said that he was robbed of multiple drilling tools during the period when the rig was sitting idle. He said that he had to replace the tools and he planned to start drilling after the first of the year. The compliance notice for expired permit is resolved.

Terry Helms called me 24 hours in advance to notify me that they were running the casing. The casing will be pulled once the well is drilled to completion; it was not cemented or mudded. The 7 inch casing was ran to a depth of 1138 feet, where the hole was reduced from 8 inches to 6.5 inches in diameter. They went back to drilling once the casing was ran. The driller reported that he was at a depth of 1665 feet. There were no leaks or spills around the drill site. I found no sags or holes in the pit liner. The fluid in the pit was approximately 6 inches from the top of the pit wall. I mentioned to the driller that they need to watch the pit level because it was high. He said that he was aware, and they still had one empty 100 barrel tank on site to pump the water into.

I found no leaks around the drilling rig or water tanks. There were no sags or holes in the pit liner.

There were no sags or holes in the pit liner and the fluid level was 8 to 10 inches below the top of the pit wall. I found no leaks or spills around the drilling rig or water tanks.

I called Terry Helms to let him know t hat he needs to take a couple loads of fluid out. Terry said that he would get Wilsons Water Hauling out today. The driller also said that they have one empty 100 barrel tank on location and he has a pump there to pump a load out of the pit into the tank. I stressed the need to both Terry and Steve that they need to get it drained down today.

The driller reported that they hit Oriskany water at a depth of 2305 feet. They are working two shifts now to carry the water. I also found that a second drill pit had been dug and lined next to the original pit. The liner overlapped to allow the first pit to drain into the second. The first pit was almost full of drill cuttings, leaving very little room for fluid. The driller said that they only got 40 barrels out when they had Wilsons Water Hauling come in on Tuesday.

I had Terry Helms walk over to inspect the pit with me again and I explained to him why I believed there was a hole in his pit liner. He agreed to have Wilson come in to drain the pit today. I requested that they pull the liner and inspect the earthen pit for sharp rocks before re-lining it. I will check back later today or tomorrow morning.

The driller was not present and they had not made any hole since the rig was down. There was one rig hand working on the drilling pits. He did find three small holes in the liner where I had suspected a leak. He tried to patch the holes, but I told him that I wanted a new liner installed. He said that he did not find any sharp rocks or roots when he was in the pit to put the patches on. He did not know what caused the holes. Terry Helms was away for a funeral, so I did not personally call him, but I did tell the rig hand multiple times that they need to put a new liner in rather than trying to patch holes.

1523541663 2018-04-12 Drill / Deepen / Reopen No Violations On the day of my inspection I found that Helms Oil was back to drilling. They were at a depth of 2715 feet. The smaller pit, which I had them re-line last month was half full of crystal clear water. Terry lined the pit with the white side of the liner facing out, so I could clearly see the bottom of the pit liner to scan for holes. There was a very thin layer of sediment that had gathered in a few spots, but most of the liner was highly visible. I did not find any holes in the liner; however, I did notice that the water level was down approximately one foot from the upper most dried sediment line on the side walls. The driller said that this was his first day drilling in almost a month, and Terry has been out maybe three or four days since he has been out sick. It is very windy where the drill site is located, on top of a crest in an open agricultural field. I asked the driller to keep an eye on the pit level and I will do the same. I warned him that if I see an unreasonable amount of perceived evaporation, now that they are back to drilling, they will need to drain the pit again.

He predicted that he has about 80 more feet to go before he reached his total depth. Terry also said that his production casing was at Buckeye to be pressure tested and drifted. The pit levels wee good, there were no sags in the liners and there were no leaks or spills around the drill site.

I did not see any pitting or excessive rust scale on the pipe. George said that Terry Helms had the pressure test paperwork. There were no sags in the pit liners and I found no leaks or spills around the drill site.

They had used, tested and drifted 4.5 inch casing set at a depth of 3308 feet. Terry Helms said that the casing was equipped with 4 centralizers and a latch-down casing shoe. Cemenco loaded the casing and pumped 65 sacks of class A cement. Circulation was established once the latch-down plug was released and Cemenco started their displacement. They landed the plug, pressured up to 500 pounds and held it for 5 minutes.

1545123312 2016-10-17 Drill / Deepen / Reopen Violations Noted On the day of my inspection I found that Terry Helms was not drilling. There was no evidence that any drilling activity had taken place since the previous inspection. There has been no reported drilling activity at this well since 5/16/16. The first notification that I received from Mr. Helms on this well was on 7/14/14, where I found that the well had already been spudded with conductor casing in the ground. The well is currently drilled to a depth of 990 feet, with 8.625 inch surface casing cemented in place at a depth of 567 feet. I have spoken to Mr. Helms on multiple occasions regarding his failure to show continued progress in well construction. Ohio Administrative Code 1501:9-1-02(I) states: Once a permit to drill has been issued pursuant to this rule, actual drilling of the well authorized by the permit shall be commenced within twelve* months of the date of issuance of such permit or the permit shall expire; if drilling is commenced but not completed within said twelve* month period, drilling shall be continued with due diligence following the twelve* month period or the permit shall expire. The current permit expired on 2/25/15, and drilling has not continued with due diligence. All drilling activity shall cease until a new/renewed drilling permit is issued. Mr. Helms has 30 days to apply for and obtain a new/renewed drilling permit for this well. If a new/renewed permit to drill is not obtained within the 30 day period, Helms Oil is required to plug and abandon the well.

1550589796 2019-02-19 Preliminary Restoration No Violations On the day of my inspection I found that Terry Helms had closed the last drilling pit. The site was still very rough in some places and still needs a final grade. There were still two trucks, one dozer, three 100 barrel tanks and three joints of tubing left at the well site. Terry still had the well plumbed directly to a 100 barrel tank that was less than 50 feet from the wellhead. There was a newer tank staged down at the existing tank battery at the lease road entrance. And there was a 2 inch diameter line buried from the wellhead in the direction of the tank battery. There was no identification posted yet. I found no leaks or spills around the well site or equipment.

The driller reported the top of the Big Lime at a depth of 2155 feet. The pit level was high again. The water on to was clear and I could see that the pit was mostly full of cuttings rather than fluid. I talked to Terry Helms about it and he said that he was going to dig another pit next to the existing pit and allow the two to communicate.

I called Terry Helms and he said that he has been trying to get it done, but the ground has been too muddy. He said that he will try to get in here next week to move the tank and do some more grading of the site.

The fluid level in the new pit was lower than what I had observed during my inspection on Friday. There was more fluid gone that what I would attribute to evaporation. The pit was lines with a white liner and the fluid was clear enough to see to bottom. I did not see any holes, but I still suspected an issue due to the amount of fluid loss from the pit. I asked Terry when the last time he had Wilsons out to take a load out of the pit. He said that Wilson hasnt been out for a while. I expressed my concerns to him and we walked over to look at the pit area. I noticed several sharp pieces of shale rock in the dirt pile from the pit excavation. I pointed the rocks out and Terry claimed that he did not see any sharp rocks sticking up when he lined the pit. I asked him to keep an eye on the fluid level. Terry maintained that it was from evaporation and wind. I made a mental note of where the level was and I will return first thing in the morning.

He did not have the flow line ran down to the main tanks yet. There were still two 100 barrel tanks staged along the access road, and three trucks left at the site. All other equipment and materials had been moved out. There were no leaks around the wellhead or tank.
