Wet ponds were completed on both sides of the site. No violation. •Disturbed earth around ongoing construction was not stabilized at the time of inspection. No violation. •Runoff water and sediment were found to have left the site LOD in two locations below the wet pond on the east side of the pad. Materials outside LOD extended into heavy brush as far as could be followed. Follow up inspection needed to verify extent of full impact. Perimeter CFS was overtopped or collapsed; lack of stabilization and improper tracking of soils in the adjacent areas combined with heavy rains are suspected to have led to the failure. Violations pending further investigation of impacts. |

•Inspection of the complainant’s spring and collection area found sediment and other indications that runoff from the site had directly impacted the complainant’s water supply. A temporary water supply was requested from the operator. •Runoff water and sediment from the site was found to have traveled around 100 yards outside the LOD from the breached perimeter controls found during the 8/1/16 inspection before entering the spring and stream system immediately downslope from the wet pond. This constitutes a violation of 35 P.S. § 691.401, 25 Pa. Code § 78.53, 25 Pa. Code § 102.4(b)(1), and 25 Pa. Code § 102.11(a)(1). •Inspection of the wet pond area found that all perimeter controls had been repaired and temporary stabilization had been implemented. |

The disturbed area was found below the sediment pond north and east of the pad, clear water was found to be leaving the sediment pond via the drain. No violation. >>Multiple small areas of animal sign and disturbed soil were found around the sediment pond. |
