Leaks and Lawsuits

In 2011, Chesapeake Energy was given contracts to drill three wells on Trax Farm properties. As of 2012, all three wells have been drilled, fracked and capped (Well Pad A). The well is not yet active and will not go into production until a new pipeline coming through Union Township is sold.[1]

EQT took over operation of the wells and began developing its own wells in surrounding areas in Fall 2012.

On December 19th, 2013, Pennsylvania Supreme Court declared Act 13 to be unconstitutional in favoring “control in favor of a statewide standard guiding where natural gas wells could be drilled.[2] Due to inconveniences including noise, gas release, and poor air quality. Act 13 municipal zoning restrictions were challenged by the Supreme Court in February 2014 and changes made are believed to empower townships to challenge gas development. Further arguments include adding environmental controls on well operators as part of permit qualifications.[2]

Community Impact

  • Complaint of fumes release. Resident began to “develop red spots on his head, eyes, and cheeks, which took up to two hours to subside.”[2]
  • Noise complaints from multiple residents. Complaints made related to closeness of homes to well pad (between 500 metres to 750 metres away) and the noise made from the wells.
  • Complaints related to the proximity of wells to homes. Complaints referencing Greene County Fire.[3][2]

Company Response

  • EQT has offered time and energy into resolving community concerns. Company finished 11 more wells in the surrounding area on February 2014 and has held township meetings to discuss Trax wells.
  • EQT has proposed using a “different rig,” which is promised to be “less noisy and have fewer emissions.”
  • EQT has provided hotel vouchers and sound studies to the community.
  • EQT has offered $50,000 in compensation per household. However, taking the money “releases EQT from any liability having to do with property or health damage.”
  • Company has reported that most residents have taken the deal.

Allowances Made

Mr. Grieb, the Union's zoning enforcement officer has initiated meetings with EQT to confront noise and emission issues. Union Township has set thresholds for noise. Proposals have been made to offer well sites conditional permits based on their noise production.

Current

Residents find that Supreme Court ruling to declare Act 13 unconstitutional is an empowerment for community control and an attempt to regulate the oil and gas industry.[4]
