I went to site for an inspection and found they had just reported a spill. Rig was shut down while they cleaned up spill,.  Approximately 3 bbls of water based drilling mud(fresh water with gel) flowed out of cellar onto containment. They had placed a pump in cellar and put discharge line in cuttings tank, but no one manned the pump and it did not operate correctly.

| The operator reported a release of approximately 2 barrels (84 gallons) of flowback fluid to the cellar when a small leak was detected.  Once discovered the fluid was immediately pumped out.  The release occurred on 10/3/2012.
 
 
 
I arrived on site at the conclusion of the fracking operations.  A new frachead had just been installed.  I met with the site foreman before conducting the inspection.  I examined the cellar where the release had occurred.  A vacuum truck was on station to pump out any residual fluid that may arise with the rainwater entering the cellar. 
 
  
There was no evidence that any material had left containment.  The cellar is composed of impermeable material and is surrounded by containment.

Cellar is full of gravel, but there is water on top - no bubbles. There are 2 open aqnnular vents w/ 0 psi that go to a poly tank. Gas meter detected 0 gas in tank. 1600+ and 1750psi on prod. This is the only well on site, unless there are any under the plastic.
2104994 Primary Facility 2012-10-04 Routine/Complete Inspection No Violations Noted The operator reported a release of approximately 2 barrels (84 gallons) of flowback fluid to the cellar when a small leak was detected. Once discovered the fluid was immediately pumped out. The release occurred on 10/3/2012.
