Code 25 3211(f) for failure to notify the Dept. 24 hours prior to commencement of drilling. Department recommends adding additional rock to access road entrance. There were various changes to the E&S plan. Although not required to be pre-approved by the Dept. for this site, BMP's were removed and replaced with unlined, unvegetated ditches. A violation under Pa. Code 25 102.11(b) is being issued for failure to adequately demonstrate to the Dept. that alternate BMP's will minimize erosion and sedimentation or manage stormwater as well as or better than original BMP's as per E&S plan. Dept. unable to locate seasonal high groundwater table data for site. Since below-grade pit may have encroached SHGWT, Dept. is requesting operator submit SHGWT information. Additional violations may be forthcoming if Operator is unable to verify pit does not encroach SHGWT. |
