Upon receipt of spill report, the Department contacted operator representative Spencer Johnson via phone at 1525.

According to Mr. Johnson: The release occurred to a crack in the bottom of the tank. The tank was empty and not actively leaking when the well tender discovered it today (7/6/17) at 1430. The tank is checked monthly by the well tender and was not leaking during last month's check. The amount released was determined by tank readings.

Per Mr. Johnson: There is a stream located approximately 320 feet north of the well site. There is no observed dead vegetation and no visible surface impacts to the stream.

Spartan is scheduled to commence remediation activities tomorrow (7/7/17). Stream testing is to be performed.

The Department recommended that immediate measures are implemented to prevent any further migration of the released brine water.

2613466 Primary Facility 2017-07-07 Incident- Response to Accident or Event Violation(s) Noted On-site inspection conducted in response to inspection record 2612916 for the reportable release of 2.5 bbl brine water.

At time of inspection, excavation of contaminated soils not yet commenced. Operator representative Mike Farrah on-site.

The Department did not observe any surrounding stressed and/or dead vegetation at this time. No visual evidence of the brine release observed in the agricultural field surrounding the well site.

A stream (South Branch Plum Creek) is located approximately 320 feet north and down-gradient of the well site. During this inspection, the Department did not observe any visual impacts to the stream as a result of the reportable brine release.

Violations are being issued for this reportable release of production fluids.

Requested written NOV response received by the Department.

2624363 Primary Facility 2017-08-04 Administrative/File Review In Compliance with Policy Admin inspection in response to inspection record 2612916 for the reportable release of 2.5 bbl brine water to the ground.

Per the Department's Spill Policy, 15 day response received by the Department. Upon review if the 15 day response, the Department contacted operator representative Mike Farrah requesting a list of COCs to be analyzed under the Alternative Remediation method as this is the method of attainment the operator has chosen to follow for the remediation of this release. Per Mr. Farrah, the brine suite identified in the Department's Program Clarification Memo will be analyzed.

The operator appears to be in compliance with policy insofar as the operator has provided a schedule and method of remediation for this release. Violations may be forthcoming pending future inspections monitoring the remediation of this release.
