The incident was the result of an operator error and had impacted soil on the pad, along the access road and an area on the outer slope of the access road. Response to the incident was immediate upon discovery. The site remediation is being conducted in accordance with Act 2/Land Recycling Program regulations in Chapter 250 of Tile 25 of the Pennsylvania Code.
The failure to contain the brine release is a violation of Title 25 Pa. Code § 91.34(a). The impact to soils by the brine is a violation of the Clean Streams Law 35 P.S. § 691.401. The operator should assess the current design and consider adjustments to prevent a release from bypassing containment in the future. At the time of my site visit on March 31, 2016, Vantage personnel were actively assessing the current design and considering changes to the set-up, as well as changes in protocol and training for contractors. |
