Beginning at the tank battery location containing three (3) 100 bbbl tanks positioned at the entrance into Paul Grims shop, two (2) tanks were wet along their sides with oily soil between both tanks and stained vegetation inside the dike. Oil impact was observed outside the dike to the 200 bbl horizontal tank (P#337 ERP tank) location approx 50 away. The backside of dike wall and area between these locations were charred, as blackened surface and partially burnt vegetation was observed. The release of oil from this tank battery location is believed to be from tank overflow. A second source of oil release was observed at the Perry tank battery located below the this location. The battery consisted of (1) 200 bbl and (1) approx 250 tank. Similar signs of burnt ground were observed along the dike walls. Fresh pooled oil approx 5 x 3 was observed around the bottom of 200 bbl tank and oil stained ground. Below the dike and over hillside, oil stained ground was observed beneath straw placed around the location. Note: the same area impacted by last years brine release has now affected by oil spill. However, a 1 to 2 wide path of oil stained ground extends beyond this location approx 40. The estimated release of oil at this time is believed to be approx 3 bbl. While at the location, Mr. Doug Kitchen was left a telephone message at 1:07 p.m. Mr. Kitchen would return call shortly thereafter, and state that he received a call from Mr. Paul Thompson, an employee with Mr. Paul Grim, over the weekend. Mr. Thompson informed him that a Perry tank had sprung a leak. Further stating that Mr. Thompson had utilized a water truck to assist with cleanup and believed he had cleanup under control. Mr. Kitchen states that equipment will be brought to location tomorrow to begin cleanup. The 200 bbl tank containing a leak will need to be replaced or repaired. Remove all contaminated ma

Spoke with Mr. Lee Atha about this on 4/19/12 at 7:36 am and he stated that he is going to have to put a service rig on the well to get it in production and he will get identification on it as soon as possible.

1254504810 2009-09-01 Production Wells Violations Noted An inspection was conducted with Mr. Jeff Fry, West Region Oil & Gas and UIC Field Supervisor. During the inspection, a bare area over hillside located below the tank battery for the Orlan Perry wells was observed. The impacted area measured approx 50 (length) x 50(width). Inside the earthen dike, contamination and pollution (C&P) was observed to include location above bare area. The earthen dike is not able to prevent escape of C&P. The 200 bbl tank for this well also contains a leak. Called Mr. Doug Kitchen at 11:24 am at his office and spoke with secretary whom, stated that he is unavailable due to a meeting. Left message for him to return call asap. Called and left message on Mr. Doug Kitchens cell phone at 11:26 am with more detail. Called Mr. Ron Mcbride, Chieftain Energy Contractor, on his cell phone at 11:30 am. No return call. Mr. Paul Grims employees were driving by location therefore flagged down. They arrived on-site at 11:56 am and were informed of inspection results. Mr. Grims empoyees state that impacted areas were caused by Doug Kitchen.

Mr. Stonerock stated to Mr. Grim that the DMRM is aware of the possible transfer of wells from Chieftain Energy to Paul Grim. More importantly, we want him to know of the existing violations such as, Permit No. 705, McGlaughlin SWIW #6. I referred to the three (3) options that had been suggested to Chieftain Energy, in order to achieve compliance with concrete dike. Mr. Grim informed that pump no longer leaking and bare areas exist at shop. Mr. Grim replied by stating that at least they would not have to mow. Informed that tanks and earthen dikes are leaking and to add organic material (horse manure, lime, seed and mulch to location(s).
