2493543 Primary Facility 2016-06-16 Preoperation Inspection No Violations Noted The Department of Environmental Protection (DEP) performed a pre-operational inspection of the JKLM Energy, LLC – Headwater 143 Well Pad located in Ulysses Twp., Potter Co. on 6/16/2016 @ 1100 hours. Present for the meeting were Jeff Long, VP Best Mananement; John Manuel, JKLM; Matt Barch, Env. Scientist JKLM; and Ronnie Burdick, Drill Supervisor JKLM. The weather was 66° overcast/rain. The well pad is located in the Cushing Hollow/Genesee Forks watershed, HQ/CWF, MF. The total project area is 19.69 acres, with 12.80 total disturbed acres.

As of today’s inspection the access road and pad surface have been final graded and soil cemented. Silt sock was observed around the perimeter of the pad area and along the access road. Contractors were in the process of hydro-seeding the cut and fill slopes of the pad, in addition to areas along the access road. 2497755 Primary Facility 2016-06-30 Routine/Complete Inspection No Violations Noted The Department of Environmental Protection (DEP) inspected the JKLM – Headwater 143 well site in Ulysses Twp., Potter Co. on 6/30/2016 @ 1100 hours. The weather was 70° sunny, winds WNW 9mph. Present for the inspection were Lester Taylor, DEP OGI and Ron Burdick, JKLM Drilling Supervisor. An adequate site ID was observed at the entrance to the access road. A copy of the E&S plan, PPC plan and copies of the well permit were observed in the mailbox onsite. Please ensure E&S inspections of the permit area are being conducted weekly and after a rain event. Documentation of E&S inspection findings should be made available onsite.

The HAD 200 rig was observed onsite during the inspection. Mr. Burdick stated the HAD rig is drilling a portion of the 5HU vertical well bore to a depth of ~2650’. The larger H&P 500 rig will then be brought in to drill to the TD. The rig matting and containment appeared to be in good shape. All regulated substances appeared to be on secondary containment. 2535587 Primary Facility 2016-11-04 Routine/Complete Inspection No Violations Noted he Department of Environmental Protection (DEP) inspected the JKLM Energy – Headwaters Pad 143 located in Ulysses Twp., Potter Co. on 11/4/2016 @ 1200 hours. The weather was 50° sun/clouds.

Puddles were observed on the pad surface and screened for field conductivity. Puddles ranged from ~195-200 µS/cm. Containment and rig matting is still in place post drilling of the 4HU and 5 HU wells. 2 rolloff containers containing drill cuttings were observed onsite. A number of strad tanks were also staged on containment, but were empty. A shark tank was located in the corner of the pad, off containment, for freshwater storage. A puddle located on containment was screened for field conductivity and measured at 236 µS/cm. All E&S controls appeared to be functioning properly. Cut/fill slopes and topsoil stockpiles appeared well stabilized with vegetation. JKLM rep stated fracing of the wells will commence after construction of the water pad has been completed. The access road and pad surface will also be soil cemented.

2547456 Primary Facility 2016-12-27 Routine/Complete Inspection No Violations Noted The Department of Environmental Protection (DEP) inspected the JKLM Energy – Headwaters Pad 143 located in Ulysses Twp., Potter Co. on 12/27/2016 @ 1300 hours. The weather was 35° sun/clouds, snow and ice on the ground melting rapidly.

No activity was observed onsite. The well pad appears covered by ice around the containment and rig matting still in place. Frac-heads were observed on the 4HU and 5HU well heads. No electronic notification for stimulation of either well has been received at this time. An orange roll-off container labeled reuse water is sitting on the well pad, off of containment. Operator is reminded under 25 Pa Code § 78a.57 if new, refurbished or replaced tanks are used to store fluids, these tanks must be equipped with secondary containment. Only wastes generated at a well site or entirely for beneficial reuse at the well site may be stored at that well site without a SWMA permit.

The Sediment trap appears to be holding water that is frozen over. RLD’s appeared stable and functional. N
