O&G discussed internally and is in agreement that the building in question certainly does meet the definition of an occupied building and should have had a 500' setback distance in-between the occupied building and the well. If Range wanted to drill the well closer than 500' to an occupied building Range should have had the landowner consent and also Department approval signed by appropriate staff.

2852746 Primary Facility 2019-03-13 Compliance Evaluation No Violations Noted Today I conducted an administrative compliance evaluation inspection regarding the Department’s prior Notice of Violation (NOV), dated November 17, 2016, which asserted that Range had drilled a well within 500 feet of a building on the Kopko Well Site without written consent in violation of Section 3215(a) of the 2012 Oil and Gas Act, 58 Pa. C.S. § 3215(a).

In responding to the NOV on December 26, 2016, Range asserted, among other things, that a May 18, 2011 Agreement signed by Michael J. Kopko, the owner of the building, constitutes written consent. Range included a copy of the May 18, 2011 Agreement with its response to the NOV; however, the map that was attached to the Agreement as Exhibit A lacked detail. On October 11, 2018, Range provided an electronic version of the May 18, 2011 Agreement and Exhibit A to the Department.
