The tank battery consists of (2) 100 barrel tanks. One of the tanks is located near the well and the other is located at the bottom of the hill near Reform Rd. This well shares the tank battery with permit number 0387. Identification was not posted at the tank battery. It appears that water has been drained from the tank near the well over the hill in the past. The well owner, Mr. James Seibert, has been notified of inspection. Mr. Seibert was informed that proper identification is required at the well and tank battery. Mr. Seibert was also advised that it is illegal to drain brine water onto the ground and that the water shall be disposed of through a registered brine hauler with the State of Ohio. Photos were taken for documentation purposes.

| This inspection was conducted as a compliance follow-up. I was accompanied by Northwest Region Supervisor Will Ziegler and Jeff Fry. The well owner Mr. Jim Seibert and landowner Mr. Jack Trumbull met us at the tank located near the well (p#0387). A remediation plan was discussed with Mr. Seibert. Mr. Seibert agreed to build a new tank battery at the bottom of the hill and set both 100 barrel tanks there. The area near the well (p#0387) will be remediated in place with lime. Mr. Seibert will work on getting p#0387 registered and production reports sent in. He was advised to place proper identification at both wells and tank battery and to make sure that brine is being hauled through a registered brine hauler. Mr. Seibert was advised to keep both wells shut-in until he is in full compliance.

Starting from the tank near the well to the tank at the bottom of the hill an area approximately 150 feet long by 10 feet wide has been extremely affected by brine kill. Several dead trees were observed in this area. The three inch valve on the tank near the well was in the open position with a three inch plug in it. A 1.25" plastic yellow line comes off the bottom of the tank and runs south approximately 75 feet and then runs over the hill towards the road (Reform Rd.). The yellow line is connected to a tee fitting that has a black plastic line coming off the middle outlet. It could not be determined if it is going to the tank at the bottom of the hill. The third outlet on the tee fitting had no valve and was open ended. It appears this has allowed brine to be drained onto the ground as there was a large area of stressed vegetation. The well operation is causing pollution and contamination. The well owner has failed to report production for 2013 on the well identified as the W & M Wills #1 (p# 0387). The well owner is also in violation for failure to register in regards to the W & M Wills #1 (p# 0387). Identification was not posted at the tanks. A phone call was placed to Mr. Jim Seibert at 10:42 AM and was informed of the inspection. Mr. Seibert stated that he was the owner of both wells on the Mills lease and he was advised to shut the wells in until further notice. A meeting will be set up with Mr. Seibert at the well to discuss well operations and a plan to resolve compliance issues. At this meeting it will be decided specifically what is required of Mr. Seibert in order for him to be in compliance and how to resolve the compliance issues. Failure to comply may result in further enforcement action. Photos were taken for documentation purposes.

-102873477 2014-04-11 This inspection was conducted as a production well status check. The well was equipped with a pumping unit and motor. It was not pumping. Identification was not posted at the well. The tank battery consists of (2) 100 barrel tanks. One of the tanks is located near the well and the other is located at the bottom of the hill near Reform Rd. This well shares the tank battery with permit number 0387. Identification was not posted at the tank battery. It appears that water has been drained from the tank near the well over the hill in the past. The well owner, Mr. James Seibert, has been notified of inspection. Mr. Seibert was informed that proper identification is required at the well and tank battery. Mr. Seibert was also advised that it is illegal to drain brine water onto the ground and that the water shall be disposed of through a registered brine hauler with the State of Ohio. The dike dimensions measured approximately 170 barrels. The tank battery consists of (1) 100 barrel tank and (1) approximately 2000 gallon tank. The old 100 barrel tank is still on location. 217583522 2014-05-28 This inspection was conducted as a compliance follow-up. This well produces into a shared tank battery with permit number 0387. Identification was not posted at the tanks. The inspection revealed that brine appears to have been drained onto the ground from the 100 barrel tank near the well (p#0387). Stressed vegetation was observed around the well and tank location. Starting from the tank near the well to the tank at the bottom of the hill an area approximately 150 feet long by 10 feet wide has been extremely affected by brine kill. Several dead trees were observed in this area. The three inch valve on the tank near the well was in the open position with a three inch plug in it. A 1.25 plastic yellow line comes off the bottom of the tank and runs south approximately 75 feet and then runs over the hill towards the road (Reform Rd.). The yellow line is connected to a tee fitting that has a black plastic line coming off the middle outlet. It could not be determined if it is going to the tank at the bottom of the hill. The third outlet on the tee fitting had no valve and was open ended. It appears this has allowed brine to be drained onto the ground as there was a large area of stressed vegetation. The well operation is causing pollution and contamination. The well owner has failed to report production for 2013 on the well identified as the W & M Wills #1 (p# 0387). The well owner is also in violation for failure to register in regards to the W & M Wills #1 (p# 0387). Identification was not posted at the tanks. A phone call was placed to Mr. Jim Seibert at 10:42 AM and was informed of the inspection. Mr. Seibert stated that he was the owner of both wells on the Mills lease and he was advised to shut the wells in until further notice. A meeting will be set up with Mr. Seibert at the well to discuss well operations and a plan to resolve compliance issues. At this meeting it will be decided specifically what is required of Mr. Seibert in order for him to be in compliance and how to resolve the compliance issues. Failure to comply may result in further enforcement action. Photos were taken for documentation purposes.
-43626847 2014-09-16 This inspection was conducted as a compliance follow-up. The inspection revealed that a new plastic tank has been set in place at the bottom of the hill. The old 100 barrel tank has not been removed. The oil around the tank has been cleaned up. The dike has not been constructed yet. Photos were taken during inspection. Well is not in compliance.

The 100 barrel tank near the well (p# 0387) has been moved to the bottom of the hill and set in the new tank battery location. The tank battery now consists of (1) 100 barrel tank and (1) plastic tank (unknown capacity). The dike wall was not complete. The old 100 barrel tank near the road has not been removed. Identification has not been posted. Mr. Seibert needs to place well (p# 0387) under his bond. Compliance issues have not been resolved.

-99140611 2014-06-05 This inspection was conducted as a compliance follow-up. I was accompanied by Northwest Region Supervisor Will Ziegler and Jeff Fry. The well owner Mr. Jim Seibert and landowner Mr. Jack Trumbull met us at the tank located near the well (p#0387). A remediation plan was discussed with Mr. Seibert. Mr. Seibert agreed to build a new tank battery at the bottom of the hill and set both 100 barrel tanks there. The area near the well (p#0387) will be remediated in place with lime. Mr. Seibert will work on getting p#0387 registered and production reports sent in. He was advised to place proper identification at both wells and tank battery and to make sure that brine is being hauled through a registered brine hauler. Mr. Seibert was advised to keep both wells shut-in until he is in full compliance.
-998895234 2014-09-29 This inspection was conducted as a compliance follow-up. The inspection revealed no change in status from previous inspection. The new tank battery and dike has not been constucted. The well owner will be contacted about non-compliance.
