Access road showed water flowing on the road and sediment deposit at the entrance way. It appears that snow plowing may have caused flow problems. Talked to the driller about the road. DEP received a call from site supervisor and forwarded him to Greg Higgins (DEP WQ) for assistance on the road access. NE Energy was at 2640 ft depth. Conductor pipe (20¿) set at 20¿. Permit was on-site. Well log was present at the site. Stratigraphy consisted of sandstone, shale and coal in this section. Soft zone possible mine at 90 ft. Mine casing at 13 3/8¿ at 140 ft with 75 sks class a. Intermediate casing was set at 9 5/8¿ set at 335 ft depth with 145 sks with 9 bbl return. 7 inch casing set at 843 ft with 160 sks with 8 bbl return. Water recorded at 180¿, 200¿ 380¿. Pit aligned with 20 mil plastic and no free board issues. Spud date called on 3/1/10. TD of well is 3650 ft depth.

Discussed with operator violations and what is required by the OG ACT, CSL, and PA Code. Department requested written response from violations outstanding /issued on 3/18/11, again today written response was requested and operator said he was in process of submitting a response as to why violations occurred and measures that will be taken to correct violations. During this inspection, well ID sign and ES plan neither present, nor well tag present. Access road continued to display accelerated erosion and sedimentation issues and bmp¿s were not maintained. Well site has not yet been restored. Pit onsite with liquid fraction and cuttings. Conveyed with operator that in order to gain compliance, well site will have to be permanently restored, pits removed and cuttings properly disposed of, placement of well tag on well head and ES plan (until final restoration is achieved). All bmp¿s shall be maintained until final/permanent restoration complete.

The Department requested documentation from Mr. Helfrick confirming that this receipt is for this well site. Mr. Helfrick stated that the dates on the well record correspond with the dates of the receipt, but agreed to search for further documentation.The Department confirmed that the WRAC was received on 8/25/2014, but has not yet been reviewed. Mr. Helfrick stated that he previously sent the WRAC to the SWRO and to OGI Paul Wyrwas within the regulated timeline, but is unable to provide any evidence to prove this.

Dept contacted Opr John Helfrick via phone to discuss status of previously issued viols issued under inspt records 1868521, 1882675, and 1959276.In response to the Dept’s 6/9/15 inspection (record 2381181), The Dept recommended that the well site is re-seeded/mulched to ensure >70% uniform and adequate vegetative growth is achieved. The Dept reviewed the regulations appropriate to well site restoration and the well site restoration report with Mr. Helfrick.The Dept recommended that all access road BMPs are properly removed per current regulations as unnecessary silt fence remained in place during the Dept's previous inspt on 6/9/15 (record 2381181). Mr. Helfrick said that he would remove the access road BMPs this weekend.Mr. Helfrick stated that the well has been out of production for approximately two months and is expected to be placed back into production next week. OGI Paul Wyrwas’ contact information was provided to Mr. Helfrick for any assistance and/or follow-up that may be needed.Outstanding violations exist.
