1941745 Primary Facility 2011-01-05 Routine/Complete Inspection Violation(s) Noted At the time of this inspection, security onsite. Well sign and ES plan onsite. No rig onsite. Appears bmp¿s have been recently maintained (ie. Snow has been removed to ensure structural integrity of bmps are not compromised). Vegetative blankets placed onsite, soil pile, and sediment traps. Ditches rock lined. No accelerated erosion or sedimentation issues observed. No pits onsite, observe five frac tanks/closed boxes. It appears that tanks were used for drill cutting disposal, but during this inspection, it is observed that drill cuttings have been placed outside of the tanks(s) on a torn structurally unsound liner. As a result a violation is being issued for failure to ¿contain all pollutional substances and wastes which are used or produced during drilling, altering, completing, and plugging the well¿ as stated in 78.56. Spoke with Chief, Matt Barch 1-11-11 Accompanied with Marc Maestra during inspection.

1943828 Primary Facility 2011-01-19 Drilling/Alteration No Violations Noted At the time of inspection, no E&S or IW discharge issues at the site. Site sign and E&S plan present. Patterson Rig 61 was in the process of being installed at the site. Well location was protected by safety plate. Tower was in the process of installation. E&S plan and site ID sign present. Heavy fog and rain/snow caused safety issues. Chief obtained local ambulance and EMT to be present during construction period.
1944353 Primary Facility 2011-01-20 Compliance Evaluation No Violations Noted On 1/11/11, dept received phone call and pictures from Matt Barch, of Chief demonstrating that roll off boxes containing cuttings have been removed. Based on pictures received, it was observed that some cuttings were still on unstable liner on pad, Mr. Barch assured me that this would be removed prior to rig moving back on site. Then on 1/17/11, dept received preliminary written response (see attached). An inspection was conducted on 1/20/11, site sign and Es plan onsite. Since last inspection, pad had been completely fenced in and 24hr security and emergency personal placed onsite. Rig currently setting up, pad covered with felt and then liner. Dept was unable to observe any remains of cuttings as all boxes and cuttings appear to have been moved off pad. No accelerated erosion or sedimentation issues noted. Access road stable. Accompanied by WQS Marc Maestra. Recommend that operator continue to closely monitor/maintain all bmps and temporary containment tanks.

Patterson Rig 61 cleaned hole. Jay Lewis (Chief company man) present. Site was running the 13 3/8¿ pipe. Casselberry was requested water samples from hole prior to setting pipe and cement from Chief. Universal present to cement. Hole stayed open. Cold temperatures (-12 F) was causing freezing of water lines and water tanks. Heaters were present to open the lines. E&S plan and site ID sign present. Chief obtained local ambulance and EMT to be present during drilling of site.

Chief informed department that this site is currently under a DCNR Restriction of limited/no access, department has plans to contact DCNR for further information on restriction and possibility of allowing operator onsite to perform bmp maintenance and/or routine inspections as required by OG regs.
