ON 2/15/16 AT 1248, A SPILL WAS REPORTED TO FIRST CHOICE TAS BY OPERATOR REPRESENTATIVE RICHY VROBEL. SPILL REPORTED TO BE CONTAINED. NO WATERWAYS REPORTED TO BE AFFECTED. OPERATOR REPORTS RELEASE RESULTED WHEN VALVE CAME OFF WHILE COLLECTING A SAMPLE.

2449503 Primary Facility 2016-02-16 Administrative/File Review In Compliance with Policy Admin inspt in response to inspection ID 2449485 for 2/15 reportable release of brine water.Upon receipt of spill notification, Dept contacted Opr rep R.Vrobel via phone at 1007.According to Mr. V, the release resulted when plug was being removed from brine tank and whole valve came off of nipple, releasing 15 bbl of brine into earthen dike.Release stopped by screwing valve back onto nipple.Mr. V stated that brine water did not leave earthen dike and no waterways have been impacted.A water truck was immediately dispatched to site to empty remaining fluids from tank and to remove standing fluids from earthen dike. Mr. Vrobel believes that fluids did not saturate ground as it was frozen at time of release.The amount released was determined by measuring level of brine water in tank before and after release.Per Mr. V,removal of all contaminated materials is scheduled for tomorrow (2/17) at 0900.Spill occurred on 2/15 at 1230 and was subsequently reported to First Choice TAS at 1248.A FUI will be conducted.
2450320 Primary Facility 2016-02-16 Incident- Response to Accident or Event Violation(s) Noted Inspection in response to Operator report of a 15 bbl release of brine into earthen dike (Inspection Record #2449485).

At time of inspection brine tank located in earthen dike. Valve at bottom of tank appears attached. No liner in dike observed; some fluids present in dike. It appears excavation of contaminated soils has not yet begun because of inclement weather. Operator anticipates beginning excavation on 2-17-16. Department recommends Operator install temporary BMP's prior to beginning earth moving activities to prevent a subsequent potential pollution event. Site and access road snow covered.

Violation being issued for discharge of brine or other fluids on or into the ground.

2463375 Primary Facility 2016-03-10 Compliance Evaluation In Compliance with Policy Admin CEI inspection to Inspection Record #2450320 where violation issued for Operator reported discharge of brine.

Department received 15 day response to NOV from Operator on 2-29-16. Operator is In Compliance with Policy at this time in as far as Operator intends to follow the Alternative Remediation requirements for clean-up of release and intends to test for the following compounds/Anions: aluminum, Barium, Boron, Iron, Lithium, Manganese, Selenium, Strontium, Vanadium, Zinc, and Chloride. A follow up inspection will be conducted to ensure site has been permanently stabilzed. Additional violations may be forthcoming pending follow up inspection.

2475448 Primary Facility 2016-04-04 Administrative/File Review In Compliance with Policy Admin inspection to Inspection Record #2450320.

Department has received Site Characterization Report for this site. Operator is utilizing Alternative Remediation to remediate a 15 bbl release of brine. Department contacted Operator Rep Jessie Valentine by phone on 4-4-16 to request resubmittal of Site Characterization Report because of error that lists property owner as CONSOL Energy. UPDATE: 4-11-16: Operator contacted Department and stated a corrected SCR will be mailed.

2475474 Primary Facility 2016-04-18 Administrative/File Review In Compliance with Policy Admin inspection to Inspection Record #2450320.

Operator Rep Jessie Valentine contacted Department by e-mail on 4-11-16 and stated that the correction to the Site Characterization Report has been made and the corrected report will be mailed that same day. UPDATE: 4-18-16: Department received corrected Site Characterization Report.

2486672 Primary Facility 2016-05-11 Routine/Complete Inspection No Violations Noted At time of inspection no E&S issues observed on access road or on site.

Well appears to be in production. Well label present and legible. Brine tank located in earthen dike appears structurally sound.

2501754 Primary Facility 2016-07-06 Routine/Complete Inspection In Compliance with Policy At time of inspection well appears equipped for production. No E&S issues observed in relation to the access road or well site. Well tag present. Brine tank located in vegetated dike appears structurally sound.

On 2-15-16 a release of 15 bbl of brine was reported to the Department. Operator stated in the 15 day response that on 2-17-16 Spartan Specialty was to excavate approximately 13.65 tons of soil from the dike. At the time of this inspection it does not appear that the excavated area is seeded or mulched. Inspected with J. Gorman. UPDATE 7-11-16: Department contacted Operator Rep Jessie Valentine by phone to verify excavation was completed and area was seeded and mulched. Mr. Valentine stated he would visit the site on 7-14-16 and follow up with Department. Photos from the 7-6-16 inspection are attached to this inspection report.

2504257 Primary Facility 2016-07-15 Administrative/File Review In Compliance with Policy Admin inspection to inspection record #2501754.

Operator Rep Jessie Valentine e-mailed Department after his site visit on 7-14-16. Mr. Valentine stated that the excavation by Spartan Specialty was done under and around the brine tank, not throughout the whole dike area. Mr. Valentine tested random spots throughout the dike area with a conductivity meter and all sampled locations showed low conductivity readings. Mr. Valentine also stated the area in the dike is "very rocky and hard" therefore the newly planted vegetation may not have grown. It appears that Operator is in compliance with policy at this time.

2550408 Primary Facility 2017-01-04 Routine/Complete Inspection No Violations Noted On-site inspection conducted to monitor site remediation as a reportable release of production fluids previously occurred at this site. Violations were issued for this reportable release under inspection record 2450320 (enf ID 334645) and subsequently corrected under inspection record 2463375.

At time of inspection, site is permanently stabilized with >70% uniform and adequate vegetative growth, appears restored. Access road stabilized. Well label present on brine tank. Department recommends Operator install well tag on well in a legible, visible, and permanent manner per current regulations. According to records, drilling occurred 3/24/2009-3/26/2009. Brine tank located on plywood base within a vegetative dike. Brine tank appears sound. Area within dike where release was previously reported to have occurred (inspection IDs 2449485, 2449503) appears stabilized with rock and vegetation. In accordance with the Spill Policy, the 15 day initial written report was received on 2/26/2016 notifying the Departme
