2487880 Primary Facility 2016-01-08 Routine/Partial Inspection No Violations Noted On 1/8/16, I performed a routine partial inspection at the Bernard Werner Site in response to an operator request to review the site in relation to an upcoming pre-op for a major modification/expansion and made the following observations:

•The site was in generally good condition and no earthwork had begun at the time of inspection. •Three active wells were on the site at the time of inspection, five further wells were permitted for the expanded pad, and one well was proposed but never materialized.

2489210 Primary Facility 2016-01-26 Preoperation Inspection No Violations Noted On 1/26/2016, I performed a preoperation inspection at the Bernard Werner site in response to an operator request and made the following observations:

•Site perimeter controls were in place and functional. •Areas of exposed earth on site that were not being actively worked on were noted to have been temporarily stabilized. •An area near the corner of the impoundment may allow water to leave the LOD. It is recommended that the CFS be extended to meet the nearby culvert. This recommendation was accepted by the operator at the time of inspection and approved as a redline request. No violation. •A roadside ditch sloping towards the pad was not rock lined at the time of inspection, due to directionality being towards site it is being considered an intermediate (not perimeter control). Per the operator it is expected to be finished by the end of the day. No violation. •Multiple redline changes were requested and approved during the inspection including addition of CFS near the entrance and the addition of two

2515196 Primary Facility 2016-05-24 Follow-up Inspection No Violations Noted On 5/24/16, I performed a follow up inspection at the Bernard Werner site monitoring issues noted on 1/26/16 (eFACTS ID: 2489198) and made the following observations:

•A moderately eroded ATV path extends from access road off site, reported to be land owner created. No violation. •The bank of the diversion channel on the up slope side of the access road was largely barren; no prominent erosion damage was noted. The diversion channel was otherwise completed and functional. No violation, remediation recommended. •The cut slope above the well pad was stabilized but was still very sparsely vegetated at the time of inspection. No violation. •The vertical shafts of 8 wells had been drilled on site and were awaiting further drilling at the time of inspection. •Additional bare or sparse patches of vegetation were found on the north side of the site access road near the well pad, one the cut slop between the well pad and the small accessory pad, and between the small pad and the impoundment. •Redline changes app
