>>An area of disturbed earth near a juncture in the site access road was noted to be unstabilized at the time of inspection. No violation, remediation recommended.

>>The exact location of the spill was unable to be determined, operator contacts with detailed information were not available at the time of inspection. No violation, further information needed for determination.

2666917 Primary Facility 2017-12-01 Follow-up Inspection No Violations Noted On 12/1/17 an incident inspection of the Werner well site was conducted in response to a spill (CTS ID: 331105) reported on 11/23/17. The following was observed:

>>The initial report was of a truck rollover that resulted in an estimated spill of 20 gallons of oil to the roadside culvert. The spill was fully cleaned at the time of the initial inspection on 11/28/17 but the location of the spill was unable to be identified. Upon locating the site of the spill cleanup appears to be complete and without further impact. While this constitutes a violation of 25 Pa. Code 78.54 in the the operator failed to control fluids associated with well servicing it has been determined that the violation was immediately corrected.

>>The unstabilized disturbed area noted on 11/28/17 remained unstabilized at the time of inspection. Continued failure to provide temporary stabilization would constitute a violation under 25 Pa. Code 102.22(b)(1).

2667086 Primary Facility 2017-12-04 Follow-up Inspection No Violations Noted On 12/4/17 an FUI inspection was conducted in response to concerns noted during a prior inspection on 12/1/17. The following was noted:

>>The unstabilized area of the site noted during a prior inspection on 12/1/17 had been stabilized at the time of inspection. No violation.

>>A small area between a section of CFS near the road juncture and the drainage channel was not stabilized. CFS at this location was also noted to be damaged. Remediation is recommended, no violation.

2686052 Primary Facility 2018-01-23 Administrative/File Review No Violations Noted On 1/23/18 an administrative inspection related to the Werner Well site was conducted in response to a complaint (CTS ID: 325462). The operator reported the complainant's concerns of potential pollution of a spring used as a partial water supply. Direct contact with the complainant found that the water had a history of methane contamination but no new or ongoing evidence of contamination. Further investigation by the DEP was declined at this time.
2715916 Primary Facility 2018-04-06 Routine/Partial Inspection No Violations Noted On 4/6/18 a routine partial inspection of the Werner Well Site was conducted in response to an operator request for permit termination review of an adjacent site. The following was observed:

>>An area at the juncture of the access road and the access road of a nearby pipeline site was found to be unstabilized with partially constructed controls and early indications of increased erosion damage. No violation, stabilization in accordance with permit conditions is strongly recommended.

>>The adjacent Werner to Smith Pipeline was reported as unconstructed with regards to the permit termination request. Evidence of pipeline construction within the planned ROW was noted as related to a separate permit.

2725909 Primary Facility 2018-04-27 Follow-up Inspection No Violations Noted On 4/27/18 a follow up inspection of the Werner well site was conducted in response to issues first noted during a 4/6/18 routine partial inspection related to permit termination of an adjacent site. The following was observed:

>>The area noted in inspection report 2715873 as unstabilized and displaying increased erosion remained in much the same condition without surface stabilization. No indication of any work being conducted in the general area during the 21 days between inspections was found. This constitutes a violation of 25 Pa. Code § 102.22(b)(1) in that the operator failed to stabilize an area during any cessation of work in excess of four days.

2815128 Primary Facility 2018-12-13 Compliance Evaluation No Violations Noted On 12/13/18 a compliance evaluation inspection of the Werner Well Site was conducted in response to violations initially noted on 4/27/18. The following was observed:

> The unstabilized area of the site that was the subject of the violations was found to be fully vegetated and stabilized with site BMPs installed. An adjacent area of recent earth work was also stabilized. No further violations were found.
